Abstract <br />
The pres<strong>en</strong>t article states that Law must be an elem<strong>en</strong>t that promotes economic <br />
developm<strong>en</strong>t. In that regard, Civil Law, through the concepts of property and mortgage, has <br />
an important role. <br />
A country that has an adequate regulation regarding property will be providing certainty to <br />
the free exchange of goods and, h<strong>en</strong>ce, will permit a correct operation of the market. <br />
Furthermore, mortgage repres<strong>en</strong>ts a guarantee that comes to consolidate the <br />
aforem<strong>en</strong>tioned certainty regarding transactions in the market. Therefore, both figures are <br />
extremely important regarding economic developm<strong>en</strong>t. <br />
In order to establish a starting point in Civil Law, the pres<strong>en</strong>t article proposes some <br />
am<strong>en</strong>dm<strong>en</strong>ts in the Costa Rican Political Constitution and in the Civil Code. The purpose of <br />
these am<strong>en</strong>dm<strong>en</strong>ts is defining the regulatory framework in which property and mortgage <br />
will operate as elem<strong>en</strong>ts that promote economic developm<strong>en</strong>t. Key words: economic <br />
