Abstract
The present article states that Law must be an element that promotes economic
development. In that regard, Civil Law, through the concepts of property and mortgage, has
an important role.
A country that has an adequate regulation regarding property will be providing certainty to
the free exchange of goods and, hence, will permit a correct operation of the market.
Furthermore, mortgage represents a guarantee that comes to consolidate the
aforementioned certainty regarding transactions in the market. Therefore, both figures are
extremely important regarding economic development.
In order to establish a starting point in Civil Law, the present article proposes some
amendments in the Costa Rican Political Constitution and in the Civil Code. The purpose of
these amendments is defining the regulatory framework in which property and mortgage
will operate as elements that promote economic development. Key words: economic
development, property, exchange of goods, market economy, mortgage.
