In addition to what it has being m<strong>en</strong>tioned, the study of the scope of the agreem<strong>en</strong>t <br />

concluded by the parties is a matter of great relevance. Since it is in the arbitration <br />

agreem<strong>en</strong>t where the int<strong>en</strong>tion of the parties is established. It is important to keep in mind, <br />

that in the religion of Arbitration, parties cons<strong>en</strong>t is sacred. The scope will determine which <br />

parties are bound to the obligation to arbitrate the disputes; it will determine the number <br />

of issues that are within the compet<strong>en</strong>ce and jurisdiction of the arbitrators; the <br />

administration of the proceedings; the method for the arbitrations for making their <br />

decision: in law or by equity; the number of arbitrators, with their respective selection <br />

method(any method that violates the equality of the parties in the proceeding, will result in <br />

an un<strong>en</strong>forceable award); the place of arbitration, and may other possible provisions 13 that <br />

can be concluded by the parties. <br />

Having in mind the importance of the constitution of the Arbitration Tribunal. This section <br />

starts pointing out the main differ<strong>en</strong>ces betwe<strong>en</strong> arbitration and the national courts <br />

system. The second part of this section will be dedicated in addressing the constitution of <br />

Arbitral Tribunals. The section will deal with some g<strong>en</strong>eral remarks of the selection of the <br />

tribunal, going through the differ<strong>en</strong>ce of arbitration proceedings that involves an <br />

institution with those who do not uses one; the qualities required by the arbitrators for a <br />

particular dispute; some possible appointm<strong>en</strong>t methods for the selection of arbitrators; <br />

and a final subsection addressing the topic of the obligation of disclosure by arbitrators, <br />

and the ev<strong>en</strong>tual chall<strong>en</strong>ge of a Tribunal. <br />
