Ocean Dumping and U.S Domestic Politics:<br />

Power-Based Regime Analysis<br />

Realists (and neoliberals) suspect th<strong>at</strong> the United St<strong>at</strong>es constructed the<br />

global ocean dumping regime so as to use it to realize its environmental<br />

objectives—<strong>at</strong> the expense of other st<strong>at</strong>es, when th<strong>at</strong> was necessary. They<br />

see the regime as closely mirroring the United St<strong>at</strong>es’ environmental interests.<br />

Realists view the global ocean dumping regime as perhaps s<strong>at</strong>isfying<br />

other foreign policy objectives of the United St<strong>at</strong>es, such as improving its<br />

bargaining position in intern<strong>at</strong>ional trade or strengthening an intern<strong>at</strong>ional<br />

organiz<strong>at</strong>ion facilit<strong>at</strong>ing cooper<strong>at</strong>ion. These foreign policy objectives are<br />

not intrinsically or primarily rel<strong>at</strong>ed to the solution of environmental problems.<br />

A 1970 U.S. administr<strong>at</strong>ion study report suggested: “Intern<strong>at</strong>ional<br />

cooper<strong>at</strong>ion on the environment may be deliber<strong>at</strong>ely undertaken and<br />

encouraged for the purpose of strengthening an intern<strong>at</strong>ional organiz<strong>at</strong>ion<br />

th<strong>at</strong> serves U.S. interests, revitalizing it, and/or to increase its capability to<br />

bring n<strong>at</strong>ions together. Sometimes the primary aim is a more specific political<br />

objective such as enhancing the United St<strong>at</strong>es’ image abroad or improving<br />

our bargaining position in intern<strong>at</strong>ional trade. In these cases, the<br />

improvement of environmental quality is a secondary consider<strong>at</strong>ion even<br />

though the desirability of th<strong>at</strong> end is acknowledged and the need for joint<br />

action to control pollution is recognized.” 1 These theorists assume th<strong>at</strong> the<br />

United St<strong>at</strong>es dict<strong>at</strong>ed the terms of the regime to other st<strong>at</strong>es through a combin<strong>at</strong>ion<br />

of coercion, co-opt<strong>at</strong>ion, and manipul<strong>at</strong>ion of incentives.<br />

In order to assess the realist approach to regime form<strong>at</strong>ion, this chapter<br />

examines the formul<strong>at</strong>ion of U.S. domestic policy, influential politicians’<br />

perception of the ocean dumping problem, Congress’s support of legisl<strong>at</strong>ion,<br />

and the economic implic<strong>at</strong>ions of U.S. domestic ocean dumping regul<strong>at</strong>ion.<br />
