Special Waste Regulations 1996 Key Features • Implements the EU Hazardous Waste Directive in the UK. • Defines special waste (hazardous waste) • Sets out the requirements and procedures for carrying and disposing of hazardous waste, including tracking waste movements. Waste streams addressed: Hazardous waste. Proposed Changes: • The Landfill Regulations 2002 introduced the term ‘hazardous waste’ to replace the ‘special waste’. • Amendments are due to be made to take into consideration recent changes to the European Waste Catalogue, including the requirement to separate special waste, where it is mixed with other waste, if it is economically and technically possible. Hazardous Waste Regulations Due to replace the Special Waste Regulations in 2004. Waste and Emissions Trading Act 2003 Key Features • Tool to meet the targets set by the Landfill Directive for diverting biodegradable municipal waste (BMW) from landfill. • Provides for the allocation of allowances, which may be tradable, to waste disposal authorities. Waste streams addressed: Principally Biodegradable Municipal Waste. Waste Minimisation Act 1998 Key Features • Enables waste collection authorities or waste disposal authorities to make arrangements to minimise the generation of controlled waste in their area. Waste streams addressed: All controlled waste. Landfill (England and Wales) Regulations 2002 Key Features • Implements the EU Landfill Directive (apart from the diversion of BMW from landfill targets) and the European Waste Catalogue into UK legislation. • Requires landfills to be classified as hazardous, non-hazardous, or inert, and prevents the co-disposal of hazardous and non-hazardous waste after July 2004. 150
• Prohibits certain types of waste being disposed of in landfill including: • any waste in liquid form; • waste which, in the conditions of landfill, is explosive, corrosive, oxidising, flammable or highly flammable;. • hospital and other clinical wastes;. • chemical substances arising from research and development or teaching activities;. • whole tyres (from 2003);. • shredded tyres (from 2006);. • Establishes a set of Waste Acceptance Criteria, and the general requirements for all landfill sites. Waste streams addressed: Hazardous, non hazardous or inert waste. Landfill Tax Regulations 1996 Key Features • The Regulations set out the basis for the tax aimed at encouraging waste producers to produce less waste and recover more value from their waste. • Acts as a mechanism to off-set the cost of landfill to make alternatives more competitive. • At 1 April 2004 the Landfill Tax rate for active waste increased by £1 to £15 per tonne. The rate for inactive waste remains at £2 per tonne. The Chancellor’s Pre- Budget Report 2002 announced that the Landfill Tax for active waste would be increasing by a minimum of £3 per tonne from 2005-06, until it reaches a rate of £35 per tonne in the medium to long term. • Through the Landfill Tax Credit Scheme, landfill site operators who make contributions to bodies with objects concerned with the environment, enrolled under the Landfill Tax Credit Scheme, may claim a credit against their annual landfill tax liability. The maximum credit that they may claim currently is 6.5 per cent of that liability. Waste streams addressed: All waste sent to landfill. Proposed Changes: Will be raised by at least £3 year on year to £35/tonne. Aggregates Levy (under the Finance Act 2001) Key Features • The objective of the levy is to address the environmental costs associated with quarrying operations and to reduce demand for aggregate and encourage the use of alternative materials where possible. 151
