16. Additional Instructions, Six in number, to pass an Act warranting<br />

<strong>the</strong> justices to pursue in absence such persons as shall be excepted<br />

out <strong>of</strong> <strong>the</strong> act <strong>of</strong> indemnity. <strong>The</strong> marginal notes are holographs <strong>of</strong> <strong>the</strong><br />

<strong>Duke</strong> <strong>of</strong> Queensberry, commissioner. Giv^en imder <strong>the</strong> hand and signet<br />

<strong>of</strong> King James, 14 May 1685, and countersigned by <strong>the</strong> Earl <strong>of</strong><br />

Morray.<br />

Additionall Instructions to William, <strong>Duke</strong> <strong>of</strong> Queensberry, our Commissioner.<br />

1. You shall passe an act <strong>of</strong> parliament warranting <strong>the</strong> Justices to<br />

persue in absence, such persons as shalbe excepted by us out <strong>of</strong><br />

<strong>the</strong> act <strong>of</strong> indemnity.<br />

2. You shall passe a law securing innocent creditors in summes due<br />

to <strong>the</strong>m by personall obligations, against <strong>the</strong> forfeiture <strong>of</strong> <strong>the</strong>ir<br />

debitors, for payment <strong>of</strong> twenty merks Scotts to <strong>the</strong> crowne,<br />

and twenty shillings Scotts to our clerk register for every<br />

thousand merks <strong>of</strong> principall summes so secured, at <strong>the</strong> lime <strong>of</strong><br />

<strong>the</strong> registration <strong>of</strong> <strong>the</strong> said obligation.<br />

3. You are allowed to nominate commissioners for <strong>the</strong> supply,<br />

justices <strong>of</strong> our peace, commissioners for <strong>the</strong> commisfjion for teinds<br />

and plantation <strong>of</strong> churches.<br />

4. You are allowed to disjoine particular lands from one shire and<br />

to joine <strong>the</strong>m to ano<strong>the</strong>r at <strong>the</strong> request <strong>of</strong> heretors, and with<br />

consent <strong>of</strong> <strong>the</strong> sheriffs, where sheriffs are heretable.<br />

5. You are to consent to such acts as <strong>the</strong> parliament shall find<br />

reasonable for adjusting <strong>the</strong> differences betwixt <strong>the</strong> Burghs<br />

Royall and those <strong>of</strong> barony and regality.<br />

6. You are to consent (at close <strong>of</strong> <strong>the</strong>'parliament) to <strong>the</strong> act salvo jure<br />

cujuslibet in common form.<br />

For doing all which this shalbe your warrant. Given under our<br />

royall hand and signett, at our court at Whitehall, <strong>the</strong> 14th day <strong>of</strong> May<br />

1685, and <strong>of</strong> our reigne <strong>the</strong> 1st year.<br />

17. Additional Instruction not to make use <strong>of</strong> <strong>the</strong> former Instruction<br />

relating to <strong>the</strong> Indemnity, seeing <strong>the</strong>re has a new rebellion since<br />

intervened. Given under <strong>the</strong> hand and signet <strong>of</strong> King James, 25<br />

May 1685, and countersigned by <strong>the</strong> Viscount <strong>of</strong> Melfort.<br />

You are not to make use <strong>of</strong> that our former Instruction relating to<br />

<strong>the</strong> Indemnity, seing <strong>the</strong>re has since a new rebellion intervened.<br />

And for your so doing, this shalbe a sufficient warrant. Given<br />

under our royall hand and signett, at our court at Whitehall, <strong>the</strong><br />

25th day <strong>of</strong> May 1695, and <strong>of</strong> our reigne <strong>the</strong> 1st year.<br />
