Grymme, and were resigned by him into <strong>the</strong> King's hands at Edinburgh<br />

by his procurators. <strong>The</strong> precept is given under <strong>the</strong> quarter seal, at Edinburgh,<br />

3 June, twenty-fourth year <strong>of</strong> <strong>the</strong> King's reign. <strong>The</strong> sheriff<br />

accordingly delivered sasine <strong>of</strong> <strong>the</strong> said lands <strong>of</strong> Raffulgill to <strong>the</strong> said<br />

Archibald Caru<strong>the</strong>ris <strong>of</strong> Mousfaulde, at <strong>the</strong> capital messuage <strong>of</strong>Raffulgill,<br />

at 2 past noon, 9 June 14^4, in presence <strong>of</strong> Eobert Ramsay and o<strong>the</strong>r<br />

witnesses.<br />

116. Notarial Instrument, in whicli John McHome, notary, narrates<br />

that in presence <strong>of</strong> himself and witnesses compeared Symon Caru<strong>the</strong>ris<br />

<strong>of</strong> Mouswalde, and held forth to him in words as follows :—Lo ! Sir<br />

Notary, it is well known to you that you formerly drew up a writing<br />

between me and John Carlell, and William Carlell, his grandson<br />

(nepotem), subscribed with our hand writs, touching matrimony to be<br />

fulfilled between me <strong>the</strong> said Symon, and Eufamea Carlelle, sister<br />

german <strong>of</strong> <strong>the</strong> said William Carlell ; in which compromit it was contained<br />

that John Lord <strong>of</strong> Carlell with my consent should get from <strong>the</strong><br />

Apostolic See as soon as possible a dispensation to contract <strong>the</strong> said<br />

marriage, and now for three months or <strong>the</strong>reby a most reverend fa<strong>the</strong>r<br />

in Christ, James " Episcopus Imolen.," legate a latere, has been and<br />

now is in this kingdom, and gives such dispensation's ; but Lord<br />

Carlell wholly postpones to get such dispensation though very <strong>of</strong>ten<br />

burdened by me to that effect, and I am always ready to complete <strong>the</strong><br />

said matrimony, &c., and protests that though for <strong>the</strong> present he could<br />

not get to <strong>the</strong> presence <strong>of</strong> Lord Carlell,- yet this should not fall to his<br />

prejudice, &c., as he was always willing to fulfil his part <strong>of</strong> <strong>the</strong> contract.<br />

Done at Barresbrig <strong>of</strong> Tynualde, 29 June 1485. Witnesses, Robert<br />

Charteris <strong>of</strong> Amisfelde, John Caru<strong>the</strong>ris <strong>of</strong> Holmendis, and o<strong>the</strong>rs.<br />

ll7o Precept by Walter Scott <strong>of</strong> Bukclewcht, on <strong>the</strong> narrative that<br />

he had sold <strong>the</strong> landsjto Symon Caru<strong>the</strong>ris <strong>of</strong> Mouswald, to give sasine<br />

to him <strong>of</strong> four merklands <strong>of</strong> Roberthill, and one merkland <strong>of</strong> Tukkisholm<br />

<strong>of</strong> old extent, in <strong>the</strong> lordship <strong>of</strong> Driffisdaill and stewartry <strong>of</strong> Annandale.<br />

118. Instrument <strong>of</strong> Sasine given by David Caru<strong>the</strong>ris, bailie in that<br />

part <strong>of</strong> Robert Charteris <strong>of</strong> Amysfeyld, on precept by <strong>the</strong> latter, <strong>of</strong> <strong>the</strong><br />

six merks <strong>of</strong> land <strong>of</strong> old extent <strong>of</strong> <strong>the</strong> lands <strong>of</strong> Trailflat, lying in <strong>the</strong><br />

barony <strong>of</strong> Amisfelde, in <strong>the</strong> sheriffdom <strong>of</strong> Drumfres, to Symon Caru<strong>the</strong>ris<br />

<strong>of</strong> Mouswald. Done on <strong>the</strong> ground <strong>of</strong> <strong>the</strong> lands, 15 January 1502-3.<br />

119. Precept <strong>of</strong> Clare Constat by Adam Earl <strong>of</strong> Boithuile, Lord<br />

Halis, and lord superior <strong>of</strong> <strong>the</strong> lands, narrating that it was well known<br />

that <strong>the</strong> late Symon Carru<strong>the</strong>ris <strong>of</strong> Moswald, knight, fa<strong>the</strong>r <strong>of</strong> Symon<br />

Carru<strong>the</strong>ris, bearer here<strong>of</strong>, died last vest in fee, &c. <strong>of</strong> <strong>the</strong> lands <strong>of</strong><br />

Dundonby, Kirtilhous and Carru<strong>the</strong>ris, in <strong>the</strong> stewartry <strong>of</strong> Annandale<br />

and sherifdom <strong>of</strong> Drumfres, that he was nearest heir to his fa<strong>the</strong>r, that<br />

<strong>the</strong> lands were held <strong>of</strong> <strong>the</strong> granter by service <strong>of</strong> blanchferm in chief<br />

charging his bailies in that part to give sasine <strong>of</strong> <strong>the</strong> lands. Signed<br />

and sealed at Edinburgh, 16 March 1511-12. Signed, "Adam Erie<br />

120. Charter by King James <strong>the</strong> Fourth, by which for <strong>the</strong> good and<br />

thankful service done and to be done to him by his well beloved<br />
