<strong>of</strong> Holywood and sheriffdom <strong>of</strong> Drunfres, <strong>of</strong> Glasgow diocese, united or<br />

belonging to <strong>the</strong> said monastery, toge<strong>the</strong>r with <strong>the</strong> <strong>of</strong>fice <strong>of</strong> Bailliary <strong>of</strong><br />

<strong>the</strong> lordship and barony ; which, being desirous to improve <strong>the</strong> condition<br />

oF <strong>the</strong> said monastery, <strong>the</strong> abbot and convent had granted and leased for<br />

a yearly ferm or pension <strong>of</strong> £80 Scots making £20 sterling more or less,<br />

to be paid half at Whitsunday and half at Martinmas to <strong>the</strong> said John<br />

and Abbots and convent for <strong>the</strong> time, with o<strong>the</strong>r conditions &c. in<br />

perpetual lease (in eraphiteosim perpetuam) to Robert Lord <strong>of</strong> Maxwel,<br />

for him and his heirs and successors. <strong>The</strong> petition presented to <strong>the</strong><br />

Penitentiary by <strong>the</strong> Abbot bore that <strong>the</strong> lease was for <strong>the</strong> evident benefit<br />

<strong>of</strong> <strong>the</strong> monastery ; and parties wished <strong>the</strong> confirmation <strong>of</strong> <strong>the</strong> Apostolic<br />

See <strong>the</strong>reupon. Wherefore, by authority <strong>of</strong> his lord <strong>the</strong> Pope, and by<br />

his special behest viva voce, he charges <strong>the</strong>ir discretions to make inquiries,<br />

and if <strong>the</strong>y found <strong>the</strong> lease to be for <strong>the</strong> evident benefit <strong>of</strong> <strong>the</strong> Monastery,<br />

to confirm it by Apostolical authority, &c. Given at Rome, at St. Peter's,<br />

under <strong>the</strong> seal <strong>of</strong> <strong>the</strong> Office <strong>of</strong> <strong>the</strong> Penitentiary, VI. Kal. Aprilis (27<br />

March) first year <strong>of</strong> pontificate <strong>of</strong> Adrian <strong>the</strong> Sixth [1523.] [Half <strong>of</strong><br />

skippet remaining, but seal gone.]<br />

172. Letters by James, Abbot <strong>of</strong> Dundranane, and Herbert, Abbot <strong>of</strong><br />

Swee<strong>the</strong>art Abbey, <strong>of</strong> Whithorn and Glasgow dioceses, judges and<br />

commissioners deputed by <strong>the</strong> Apostolic See, addressed to all and sundry<br />

lords, abbots, priors, deans, &c., stating that <strong>the</strong>y had received letters<br />

from Lawrence Priest Cardinal, with Seal <strong>of</strong> <strong>the</strong> greater Penitentiary<br />

attached and delivered to <strong>the</strong>m by Robert Lord Maxwell, given at St.<br />

Peters at Rome, VI. Kal. Aprilis 1st year <strong>of</strong> Adrian's pontificate<br />

requiring <strong>the</strong>m to inquire into <strong>the</strong> value <strong>of</strong> <strong>the</strong> lands <strong>of</strong> Keyr, &c. [as in<br />

No. 170.] After reading which letters, <strong>the</strong> Judges were earnestly<br />

requested by Lord Maxwell to make citation <strong>of</strong> parties, John Abbot <strong>of</strong><br />

Holywood and o<strong>the</strong>rs, to be affixed on <strong>the</strong> doors <strong>of</strong> <strong>the</strong> metropolitan<br />

church <strong>of</strong> Glasgow, and cite <strong>the</strong> said John Abbot <strong>of</strong> Holywood and<br />

o<strong>the</strong>rs having interest to appear before <strong>the</strong>m in <strong>the</strong> parish church <strong>of</strong><br />

Begar, on <strong>the</strong> 16th <strong>of</strong> September instant, to hear <strong>the</strong>ir decision about <strong>the</strong><br />

lease <strong>of</strong> <strong>the</strong> said lands <strong>of</strong> Keyr and o<strong>the</strong>rs : and also summoning John<br />

Maxwell <strong>of</strong> Carnsalloche, Vv^'illiam Maxwell, tutor <strong>of</strong> Tynvald, Fergus<br />

Dungallsone and o<strong>the</strong>rs to bear witness about <strong>the</strong> value <strong>of</strong> <strong>the</strong> lunds.<br />

Dated at Edinburgh <strong>of</strong> St. Andrews diocese, 4th September 1523.<br />

Witnesses, Schir Thomas Nudrie, prothonotary <strong>of</strong> <strong>the</strong> Apostolic See<br />

and Commendator <strong>of</strong> <strong>the</strong> Monastery <strong>of</strong> Culros, Adam Steuart, burgess<br />

<strong>of</strong> Edinburgh and o<strong>the</strong>rs.<br />

<strong>The</strong> messengers execution states than on 10 September, John <strong>the</strong> abbot<br />

and convent <strong>of</strong> Holywood were cited as above; On same date John<br />

Maxwell <strong>of</strong> Carnsallach and William Maxwell <strong>of</strong> Blarboy, &c., and on<br />

J 3th all having interest were summoned in <strong>the</strong> monasterial and parochial<br />

church <strong>of</strong> Holywood.<br />

173. Letters containing <strong>the</strong> process and confirmation t'ollowing upon<br />

<strong>the</strong> preceding commission by James, Abbot <strong>of</strong> Dundranane, and Herbert,<br />

abbot <strong>of</strong> Swee<strong>the</strong>art Abbey. In <strong>the</strong>se letters <strong>the</strong>y narrate <strong>the</strong> presentation<br />

to <strong>the</strong>m <strong>of</strong> <strong>the</strong> foregoing commission by Robert, Lord Maxwell,<br />

before notary and witnesses. <strong>The</strong> commission itself is engrossed. Next<br />

follows <strong>the</strong> charter itself by John, Abbot <strong>of</strong> <strong>the</strong> Monastery <strong>of</strong> lloh'wood<br />

and convent, [etc. No. 170 supra.^<br />

This charter and commission was presented to <strong>the</strong> Judges by Lord<br />

Maxwell who craved execution. <strong>The</strong> judges having first warned <strong>the</strong><br />

Abbot and Convent and o<strong>the</strong>rs having interest to appear before <strong>the</strong>m in
