Brisbane in <strong>the</strong> process pursued by her against <strong>the</strong> Earle <strong>of</strong> Leveu<br />

before <strong>the</strong> parliament, if he please.<br />

<strong>The</strong> Bill given in by <strong>the</strong> Lairds <strong>of</strong> Cessnock, elder and younger, for<br />

ane exculpation, being read, <strong>the</strong> consideration <strong>the</strong>re<strong>of</strong> continued untill<br />

tho next meeting.<br />

<strong>The</strong> Lord Tarbet did make report to his Majestie's Commissioner<br />

and <strong>the</strong> Lords <strong>of</strong> <strong>the</strong> Articles, that <strong>the</strong> Committee appointed to consider<br />

<strong>of</strong> ane Act for regulating <strong>the</strong> collection <strong>of</strong> <strong>the</strong> Excise, having mett,<br />

and finding that by <strong>the</strong> Act past in this parliament, tho Excise is<br />

appointed to be collected in manor prescrived in <strong>the</strong> Act <strong>of</strong> parliament<br />

1681, and that be that Act his Majestie has <strong>the</strong> power <strong>of</strong> appointing<br />

collectors for inbringing <strong>of</strong> <strong>the</strong> Excise, <strong>the</strong> Committee conceaved that<br />

<strong>the</strong>re remained nothing to be done by <strong>the</strong> parliament in relation to <strong>the</strong><br />

ordering <strong>the</strong> collection <strong>of</strong> <strong>the</strong> Excise.<br />

<strong>The</strong> proclamation <strong>of</strong> <strong>the</strong> Councill anent quartering, founded on <strong>the</strong><br />

Kings letter, appointed to be considered.<br />

<strong>The</strong> draught <strong>of</strong> ane Act appointing that all clerks <strong>of</strong> courts should<br />

be notars, being brought in and read, it was putt to <strong>the</strong> vote if <strong>the</strong> Act<br />

should be rejected or not, and it was carried in <strong>the</strong> negative ; and<br />

<strong>the</strong>reafter <strong>the</strong> Act was restricted to <strong>the</strong> clerks <strong>of</strong> sheriff, commisser,<br />

Stewart and regalitie courts and <strong>the</strong> clerks <strong>of</strong> burghs royall and <strong>of</strong><br />

regality and delayed to be past untill it be fur<strong>the</strong>r considered.<br />

Ane overture being made, that for preventing <strong>the</strong> prejudice <strong>the</strong><br />

Hedges may sustaine by <strong>the</strong> loss <strong>of</strong> <strong>the</strong>ir principal seasings, that <strong>the</strong><br />

nottar who takes <strong>the</strong> seasing be holden to give to <strong>the</strong> pairty two<br />

au<strong>the</strong>ntick instruments <strong>of</strong> seasing, and that when <strong>the</strong> seasing is<br />

registrat one <strong>of</strong> <strong>the</strong>m be left as <strong>the</strong> warrand at <strong>the</strong> register, which is<br />

to be considered.<br />

<strong>The</strong> draft <strong>of</strong> ane Act read, ratifying <strong>the</strong> priviledges <strong>of</strong> <strong>the</strong> ordinarie<br />

senatours <strong>of</strong> <strong>the</strong> Colledge <strong>of</strong> Justice, and all Acts made <strong>the</strong>reanent,<br />

and particularly <strong>the</strong> 8th act <strong>of</strong> <strong>the</strong> 2d session <strong>of</strong> <strong>the</strong> 2d parliament <strong>of</strong><br />

King Charles 2d, anent <strong>the</strong>ir immunitie from publick bur<strong>the</strong>ns. <strong>The</strong> Act<br />

appointed to be made more breiffe in <strong>the</strong> narrative and to be brought in.<br />

Ane Act for cleering resett and intercommuning with rebells, being<br />

read and debated, it was remitted to <strong>the</strong> President <strong>of</strong> <strong>the</strong> Session, his<br />

Majesties' Advocat, <strong>the</strong> Justice Clerk and Sir George Lockhart to meet<br />

in <strong>the</strong> afternoone, and to consider how that Act shall be worded and to<br />

bring in <strong>the</strong> same to morrow.<br />

It is remitted to <strong>the</strong> same committee to consider <strong>the</strong> bills given in<br />

for exculpations, if <strong>the</strong> same should be granted or not, and if <strong>the</strong>se<br />

persones can have summonds <strong>of</strong> exculpation, who are not in prison and<br />

doe not find caution to compear.<br />

<strong>The</strong> committee nominat to consider <strong>the</strong> Act anent Tailzies appointed<br />

to meet in <strong>the</strong> afternoone.<br />

<strong>The</strong> cash-keeper appointed to see <strong>the</strong> petition given in by <strong>the</strong> heretours<br />

<strong>of</strong> <strong>the</strong> shire <strong>of</strong> Argyle for a valuation in that shire, and to answer<br />

tomorrow.<br />

Vpon <strong>the</strong> Laird <strong>of</strong> Pittarro his petition, warrand given for citation <strong>of</strong><br />

<strong>the</strong> Earle <strong>of</strong> Lauderdale and u<strong>the</strong>rs against <strong>the</strong> twenty <strong>of</strong> this instant-<br />
