death super convictione, though lacking a lawful commission, <strong>of</strong> all and<br />

sundry persons <strong>of</strong> whatever quality or rank which were sought for,<br />

seized and imprisoned and punished with death by him, at his command,<br />

54. Charter by George <strong>of</strong> Dunbarre, Earl <strong>of</strong> March, by which he<br />

grants to John Mautalent, for his homage and service, all his lands and<br />

tenements <strong>of</strong> his barony <strong>of</strong> Tybres with <strong>the</strong>ir whole pertinents, to wit, <strong>the</strong><br />

town (villam) <strong>of</strong> Tybres with <strong>the</strong> dominical lands and mill, multures, and<br />

sequels, Glengerrok, Auchyngasylle, Auchynawht, Auchbynbany, Dubbillay,<br />

Klouchyngare, Knokbaen, Penpount, with mill, multures and<br />

sequels, and all his lands lying between Scharre and Schynnylle with all<br />

<strong>the</strong>ir pertinents, excepting to <strong>the</strong> granter and his heirs, his messuage, <strong>the</strong><br />

moat (monte) <strong>of</strong> Ihe Castle <strong>of</strong> Tybris, with Dalgernok, and <strong>the</strong> lands <strong>of</strong><br />

<strong>the</strong> free tenants lying within <strong>the</strong> foresaid lands ; to be holden b}^ <strong>the</strong><br />

said tTohn and Robert, his son. born <strong>of</strong> <strong>the</strong> granter's sister Agnes, and<br />

<strong>the</strong> heir or heirs proceeding from <strong>the</strong> said Robert, <strong>of</strong> <strong>the</strong> granter and<br />

his heirs whomsoever, for rendering three suits yearly at <strong>the</strong> granter's<br />

court <strong>of</strong> Tybres, and to <strong>the</strong> King forensic service, so much as belonged<br />

to <strong>the</strong> lands. A clause <strong>of</strong> warrandice engages to defend <strong>the</strong> lands<br />

*' contra omnes exules tam homines quam feminas nunc ad fidem et<br />

John Beset, knight, lord <strong>of</strong> Clerkyntoun, in <strong>the</strong> hands <strong>of</strong> a great and<br />

magnific lord, and his lord, George <strong>of</strong> Dunbarre, Earl <strong>of</strong> March, lord<br />

<strong>of</strong> Annandale and Man, all right or claim which he had or might have<br />

in <strong>the</strong> lands with <strong>the</strong>ir pertinents whatsoever <strong>of</strong> Dorsqwen, Glenkode,<br />

Croghelyn, Douwyn, Aghenbrekis, Bennan, Corforlvn, or in all o<strong>the</strong>r<br />

lands with <strong>the</strong>ir pertinents, if he held any in capite <strong>of</strong> his said Lord,<br />

within <strong>the</strong> barony <strong>of</strong> Tybris ; so that nei<strong>the</strong>r he nor his heirs, nor any<br />

o<strong>the</strong>r person in his name, could challenge any right or claim to <strong>the</strong> said<br />
