Instructions to our right trusty and right entirely beloved cousin and<br />

councellor, William, <strong>Duke</strong> <strong>of</strong> Queensberry, our commissioner for<br />

holding <strong>the</strong> first session <strong>of</strong> our next ensuing parliament <strong>of</strong> our<br />

ancient Kingdome <strong>of</strong> <strong>Scotland</strong>.<br />

1. You are to passe an act in favours <strong>of</strong> <strong>the</strong> Pi'otestant religion and<br />

church.<br />

2. You are to endeavour <strong>the</strong> obtaining an Act containing an <strong>of</strong>fer <strong>of</strong><br />

lives and fortunes to us, to be commanded and employed by us, as<br />

wee shall think fit, and to stand by us and our interests upon all<br />

events, from sixty to sixteen.<br />

3. You are to endeavour <strong>the</strong> obtaining an act asserting our Prerogative<br />

over all persons and in all causes, in most ample form.<br />

4. You are also to endeavour <strong>the</strong> obtaining an act continuing <strong>the</strong><br />

excise during our life, in <strong>the</strong> most ettectuall and convenient<br />

manner.<br />

0. You are likewise to endeavour <strong>the</strong> obtaining <strong>of</strong> three utonths cesse<br />

over all <strong>the</strong> kingdome, to continue during <strong>the</strong> time <strong>of</strong> <strong>the</strong> current<br />

supply ; and both to be prolonged for five years after <strong>the</strong> five<br />

years last given : and <strong>the</strong> said three months cesse to commence,<br />

at Whitsunday in this present year <strong>of</strong> God 1685.<br />

6. You are to passe an act for making confessions before <strong>the</strong> justices<br />

probative to juries.<br />

7. You are to passe an act for allowing tryalls upon 24 houres against<br />

criminall prisoners for high treason.<br />

8. You are to passe an act for securing mfnlsters from violence or<br />

outrage, under certaine paines on <strong>the</strong> parishioners who doe not<br />

act for <strong>the</strong>ir help, where<strong>of</strong> <strong>the</strong> application is to be referred to <strong>the</strong><br />

Privy councell.<br />

9. You are to passe an act obliging masters to insert clauses <strong>of</strong><br />

regularity, especially rising in armes, in all tacks in time coming,<br />

under certain paines ; and to answer for <strong>the</strong>ir tennants.<br />

10. You are to passe an act for clearing ihe crimes <strong>of</strong> resett and intercommuning.<br />

1 1 You are to endeavour <strong>the</strong> obtaining an act making husbands lyable<br />

for <strong>the</strong> faults <strong>of</strong> <strong>the</strong>ir wives, in <strong>the</strong> most effectuall manner, and<br />

in what cases.<br />

12. You are to endeavour <strong>the</strong> obtaining an act obliging witnesses, to<br />

depone in matters <strong>of</strong> treason, under <strong>the</strong> certification due to <strong>the</strong><br />

crime for which <strong>the</strong> pannell is indicted.<br />

13. You are to passe an act defining <strong>the</strong> punishments <strong>of</strong> refusing <strong>the</strong><br />

oath <strong>of</strong> allegiance, and including <strong>the</strong>rein <strong>the</strong> oath <strong>of</strong> prerogative,<br />

under any arbitrary punishment not reaching life or limb.<br />

14. You are to passe an act perpetuating intailes.<br />

15. You are to passe an act approving <strong>the</strong> actings <strong>of</strong> <strong>the</strong> kings<br />

ministers, <strong>of</strong>ficers, councellers and judicatures, and securing <strong>the</strong>m<br />

fully for <strong>the</strong>ir actings in his Majestys service, in most ample<br />

forme.<br />

10. You are to passe an act ratifying <strong>the</strong> forfeiture <strong>of</strong> <strong>the</strong> late Earl<br />

<strong>of</strong> Argile, and dissolving <strong>the</strong> surname <strong>of</strong> Campbell and McAllan.<br />

17. You are to passe an act regulating <strong>the</strong> method <strong>of</strong> succeeding to<br />

estates, so as to secure creditors by obliging <strong>the</strong> successor, if he<br />

shall acquire <strong>the</strong> paternal estate, to pay <strong>the</strong> debts <strong>of</strong> <strong>the</strong> family.<br />

18. You are to passe an act for fur<strong>the</strong>r security <strong>of</strong> <strong>the</strong> registrations,<br />

and preserving <strong>of</strong> records.<br />
