40. Contract <strong>of</strong> Marriage betwixt Walter Ker <strong>of</strong> Cessfurd, knight,<br />

and William Ker, his eldest son in life, on one part, and James Douglas<br />

<strong>of</strong> Drumlangrig, knight, for himself and taking <strong>the</strong> burden on him for<br />

Jonet Dowglas, his daughter, on <strong>the</strong> o<strong>the</strong>r part, by which William<br />

agrees to marry <strong>the</strong> said Jonet before <strong>the</strong> 10th day <strong>of</strong> May next " or<br />

soner as salbe thocht expedient be <strong>the</strong> saidis Walter and James."<br />

Before which <strong>the</strong> said William binds himself to cause himself to be<br />

served heir to <strong>the</strong> late Andrew Ker <strong>of</strong> Cavertouu, knight, his bro<strong>the</strong>r,<br />

in all his lands, and get himself seized <strong>the</strong>rein ; and <strong>the</strong>reafter, with<br />

advice <strong>of</strong> his fa<strong>the</strong>r, shall infeft <strong>the</strong> said Jonet " in hir wedowheid," in<br />

liferent, in <strong>the</strong> lands <strong>of</strong> Cavertoun, with mains, fishings and mills, in<br />

<strong>the</strong> sheriffdom <strong>of</strong> Roxburgh. Walter Ker agrees to hold <strong>the</strong> said<br />

William and Jonet in his household and family so long as <strong>the</strong>y please<br />

to remain, and shall cause <strong>the</strong>m enjoy <strong>the</strong> lands <strong>of</strong> Clarelaw to <strong>the</strong>ir<br />

support and entertainment during his life, or, if Clarelaw were taken<br />

from <strong>the</strong>m by law, to lands <strong>of</strong> <strong>the</strong> same value. If it pleased not <strong>the</strong> said<br />

William and Jonet to remain in household with <strong>the</strong> said Walter " hot<br />

draw <strong>the</strong>m to thair awin hous," he shall enter <strong>the</strong>m to <strong>the</strong> 40 merk land<br />

<strong>of</strong> Cesfurde with <strong>the</strong> tower and fortalice <strong>the</strong>re<strong>of</strong>, with mills and mains<br />

<strong>of</strong> <strong>the</strong> same plenished as <strong>the</strong>y were "with seid, oxin, and o<strong>the</strong>r plenissing<br />

necessar," and to <strong>the</strong> teind sheaves <strong>the</strong>re<strong>of</strong>, he paying to <strong>the</strong> Abbot<br />

<strong>of</strong> Jedburgh <strong>the</strong> maills used and wont, toge<strong>the</strong>r with <strong>the</strong> mill <strong>of</strong> <strong>the</strong><br />

lordship <strong>of</strong> Prymeside, to be enjoyed by <strong>the</strong>m during <strong>the</strong> said Walter's<br />

lifetime. If William deceased before his fa<strong>the</strong>r, <strong>the</strong> latter binds himself,<br />

and William binds his heirs to pay <strong>the</strong> said Jonet in <strong>the</strong> burgh <strong>of</strong><br />

Edinburgh <strong>the</strong> sum <strong>of</strong> 300 merks yearly for her liferent <strong>of</strong> Cavertoun,<br />

which she is bound to set to Walter or his son's heirs for <strong>the</strong> said sum<br />

yearly. For security <strong>of</strong> <strong>the</strong> payment sufficient burgess men <strong>of</strong> Edinburgh<br />

were to be acted in <strong>the</strong> Books <strong>of</strong> Council. For all which causes<br />

<strong>the</strong> said James shall pay to <strong>the</strong> said Walter <strong>the</strong> sum <strong>of</strong> 3000 merks<br />

Scots at <strong>the</strong> terms specified. <strong>The</strong> Contract to be registered in <strong>the</strong><br />

41. Letters <strong>of</strong> Remission by Henry and Mary, King and Queen<br />

<strong>of</strong> Scots, by which <strong>of</strong> <strong>the</strong>ir special grace <strong>the</strong>y remit to <strong>the</strong>ir beloved<br />

James Douglas <strong>of</strong> Drumlangi'ig, knight, and William Douglas <strong>of</strong> Hawik,<br />

knight, his son and apparent heir, and <strong>the</strong>ir '* parentes," friends, men,<br />

tenants and servitors, and whatever o<strong>the</strong>rs had been in <strong>the</strong>ir company,<br />

all rancour <strong>of</strong> mind, royal suit or action competent to <strong>the</strong>m, for <strong>the</strong>ir<br />

treasonable reset, supply and intercommuning with James, Earl <strong>of</strong><br />

Andrew, Earl <strong>of</strong> Ro<strong>the</strong>s, and o<strong>the</strong>rs <strong>the</strong>ir rebels, being at <strong>the</strong>ir<br />

horn, in <strong>the</strong> months <strong>of</strong> August and seventh <strong>of</strong> September last and<br />

October instant, provided <strong>the</strong>y made satisfaction to parties complaining<br />

and take <strong>the</strong>m under <strong>the</strong>ir firm peace, &c. To endure during <strong>the</strong> life<br />

<strong>of</strong> each <strong>of</strong> <strong>the</strong>m. <strong>The</strong> great seal attached. At Edinburgh, 28 October<br />
