<strong>the</strong> parish church <strong>of</strong> Begar, on 16th instant September, at 10 forenoon,<br />

&c., on which day <strong>the</strong> commissioners sitting in judgment, Kobert, Lord<br />

Maxwell compeared before <strong>the</strong>m and reported <strong>the</strong> citatory letters duly<br />

executed and indorsed, parties were .thrice summoned &c., when John,<br />

Abbot, appeared for himself and Schir John Tumour, priest and notary<br />

public in name <strong>of</strong> <strong>the</strong> convent, <strong>the</strong> commission, &c., being read no one<br />

appeared to object ; and at <strong>the</strong> request <strong>of</strong> Lord Maxwell <strong>the</strong> parties not<br />

compearing were denounced as contumacious, and silence imposed upon<br />

<strong>the</strong>m; and <strong>the</strong> judges proceeded to execute <strong>the</strong> commission. By<br />

examination <strong>of</strong> trustworthy witnesses, and <strong>the</strong> abbot and procurator<br />

for <strong>the</strong> convent, <strong>the</strong> judges found <strong>the</strong> statements in <strong>the</strong> commission<br />

and charter to be true and tlie lease to be for <strong>the</strong> evident utility <strong>of</strong><br />

<strong>the</strong> monastery ; and at <strong>the</strong> request <strong>of</strong> Lord Maxwell (iecern and<br />

declare <strong>the</strong> grant and lease, charter and letters, &c., to be for <strong>the</strong><br />

benefit <strong>of</strong> <strong>the</strong> monastery, and to be ratified and confirmed by Apostolical<br />

authority, &c. <strong>The</strong> Instrument <strong>of</strong> Process is directed to be subscribed<br />

and published in <strong>the</strong>ir presence by <strong>the</strong> scribe, and <strong>the</strong> Judges' seals to be<br />

appended. Done in <strong>the</strong> parish church <strong>of</strong> Begar, 16 September 1523.<br />

Medici), in favour <strong>of</strong> William Steward, provost <strong>of</strong> <strong>the</strong> church <strong>of</strong> St.<br />

Mary <strong>the</strong> Virgin <strong>of</strong> Lynclowden, <strong>of</strong> Glasgow diocese, to whom <strong>the</strong><br />

is directed. <strong>The</strong> pope states that he intended to appoint him to be<br />

bishop <strong>of</strong> <strong>the</strong> church <strong>of</strong> Aberdeen, and in case he were bound by<br />

any sentences, censures or ecclesiastical pains, he absolves him from any<br />

sentences or pains <strong>of</strong> excommunication, suspension and interdict, in<br />

order that <strong>the</strong> provision foresaid might take effect. Given at Rome, at<br />

superior <strong>of</strong> <strong>the</strong> underwritten lands, granting to <strong>the</strong>ir well-beloved<br />

Eobert Kirkpatrik, son and heir male <strong>of</strong> <strong>the</strong> late John Kirkpatrik <strong>of</strong><br />

Alisland, begotten between him and <strong>the</strong> late Egidia Greirsoun, his<br />

spouse, for <strong>the</strong> time, and his heirs male whomsoever, whom failinor <strong>the</strong><br />

eldest <strong>of</strong> his heirs female without division, <strong>of</strong> all and whole <strong>the</strong> six merk<br />

land <strong>of</strong> Brachath <strong>of</strong> old extent, in <strong>the</strong> barony <strong>of</strong> Haly wod, and sheriffdom<br />
