102. Charter by Thomas <strong>of</strong> Kyrkpatrik, Knight, lord <strong>of</strong> Kyllosbern,<br />

whereby he grants to his well beloved bro<strong>the</strong>r, Roger <strong>of</strong> Kyrkpatrik, all<br />

his lands <strong>of</strong> Penersex with <strong>the</strong> pertinents ; to be held by <strong>the</strong> said Roger,<br />

for all <strong>the</strong> time <strong>of</strong> his life, as quietly and freely as <strong>the</strong> granter held<br />

<strong>the</strong>m ; with warrandice by Thomas and his heirs against all mortals.<br />

George <strong>of</strong> Kyrkpatrik, son <strong>of</strong> his cousin Sir Thomas <strong>of</strong> Kyrkpatrik,<br />

lord <strong>of</strong> Kyllysbern, for his service, <strong>the</strong> whole lands <strong>of</strong> Penersex, within<br />

<strong>the</strong> regality <strong>of</strong> Anandale, and sheriffdom <strong>of</strong> Drumfres, with tenaodries<br />

and services <strong>of</strong> free tenants <strong>the</strong>re<strong>of</strong>, and advocation and donation <strong>of</strong> <strong>the</strong><br />

church <strong>the</strong>re<strong>of</strong>, all resigned in <strong>the</strong> town <strong>of</strong> Drumfres by <strong>the</strong> said Sir<br />

Thomas ; To be held to <strong>the</strong> said George, and <strong>the</strong> lawful heirs male <strong>of</strong><br />

his body, whom failing to <strong>the</strong> said Sir Thomas, and <strong>the</strong> lawful heirs<br />

104. Letters <strong>of</strong> Quitclaim by Edward <strong>of</strong> Craufurd, son and heir <strong>of</strong><br />

" lone " <strong>of</strong> Craufurd, lord <strong>of</strong> Trarinzan, by which he renounces for liim<br />

and his heirs " till a worschipfull lord," Sir Thomas <strong>of</strong> Kyrkpatrik,<br />

lord <strong>of</strong> Killosbern, *' and to George <strong>of</strong> Kyrkpatrik, his sone naturall,"<br />

all right he had to <strong>the</strong> " landis <strong>of</strong> <strong>the</strong> town <strong>of</strong> Dalgarnok," <strong>the</strong> Lang<br />

Cr<strong>of</strong>t, in <strong>the</strong> barony <strong>of</strong> Teberis and sheriffdom <strong>of</strong> Drumfres, and all<br />

o<strong>the</strong>r conditions and bands betwixt Sir Thomas and his son and him,<br />

which <strong>the</strong> said Thomas and George had in possession at <strong>the</strong> making<br />

here<strong>of</strong>. If Crawfurd, or his heirs, should do or suffer to be done anything<br />

contrary to this obligation, <strong>the</strong> penalty to be paid to Kyrkpatrik,<br />

&c., was to be £200 Scots, in <strong>the</strong> Friars <strong>of</strong> Drumfres, on <strong>the</strong> high altar,<br />

" on a day be twix <strong>the</strong> rysing and <strong>the</strong> ganging to rest <strong>of</strong> <strong>the</strong> sone,"<br />

before he or his heirs could be heard in judgment making any claim, &c.<br />
