fishing which is called Clutesker, with one fishing which is called<br />

Baysenette which he [Heriz] held <strong>of</strong> <strong>the</strong> chief lords <strong>of</strong> Annandale<br />

(Vallis Anand), in <strong>the</strong> tenement <strong>of</strong> Anaud, with <strong>the</strong>ir sure marches and<br />

freedoms ; to be held <strong>of</strong> <strong>the</strong> chief lords <strong>of</strong> Annandale for rendering <strong>of</strong><br />

services due and wont. If Sir William and Margaret died without<br />

lawful heir <strong>of</strong> <strong>the</strong>ir bodies, <strong>the</strong> granter wills for himself and his heirs<br />

that <strong>the</strong> said fishings should remain with Sir William and his heirs and<br />

assignees without any condition for ever. <strong>The</strong> granter warrants <strong>the</strong><br />

fishings " contra omnes gentes warantizabimus," first to <strong>the</strong> parties, and<br />

<strong>the</strong>n to Sir William's heirs and assignees as above. Witnesses, Sirs<br />

Anandale and Man, by which he certifies that he had seen and diligently<br />

understood <strong>the</strong> copy <strong>of</strong> a charter <strong>of</strong> Robert <strong>of</strong> Brnjs <strong>of</strong> good memory,<br />

illustrious King <strong>of</strong> Scots, as follows :—Charter by Robert, King <strong>of</strong><br />

Scots, granting to his well beloved and faithful Adam de la Chambre all<br />

<strong>the</strong> land which formerly belonged to Emmot Rede, lying in <strong>the</strong> town <strong>of</strong><br />

M<strong>of</strong>fet in Anandale, with le " forelandis " <strong>of</strong> <strong>the</strong> said town : to be held<br />

<strong>of</strong> <strong>the</strong> King and bis heirs, to <strong>the</strong> said Adam, his heirs and assignees,<br />

with all <strong>the</strong>ir just pertinents, right meiths and marches, in meadows,<br />

plains and pastures, moors, marches, ways, paths, and in waters, woods<br />

<strong>of</strong> M<strong>of</strong>fetdale and <strong>of</strong> Auendale, for building and burning, with brewhouse<br />

(bracina) and butcher-house (carnificio), to ^ell at <strong>the</strong>ir will<br />

without <strong>the</strong> use <strong>of</strong> inspectors for estimating <strong>the</strong> price <strong>of</strong> ale and flesh,<br />

freely, quietly, and also free from multure in <strong>the</strong> Mill <strong>of</strong> M<strong>of</strong>iet and from<br />

'*tolle" within Anandale " de cariag et pulca?," with all o<strong>the</strong>r commodities.<br />

<strong>The</strong> King also grants to Adam and his heirs a t<strong>of</strong>t wherever<br />

he should choose in <strong>the</strong> common <strong>of</strong> M<strong>of</strong>fet for building and dwelling,
