177. Charter by Thomas, commendator <strong>of</strong> Holy wood, and convent<br />

<strong>the</strong>re<strong>of</strong>, for benefits done to <strong>the</strong>m by John Maxwell <strong>of</strong> Terreghs, Knight,<br />

tutor and governor <strong>of</strong> John, Lord Maxwell, and in augmentation <strong>of</strong><br />

<strong>the</strong>ir rental, &c., letting in feu farm heritably to John, Lord Maxwell,<br />

and his heirs male, <strong>the</strong>ir mills <strong>of</strong> Keir and AUantoun, with watergang,<br />

multures and sequels <strong>of</strong> all lands that formerly paid multures to <strong>the</strong> mills<br />

or are knoAvn to pay to <strong>the</strong> mills in time coming, in <strong>the</strong> sheriffdom <strong>of</strong><br />

Drumfres, extending yearly in <strong>the</strong>ir rental in ferms and o<strong>the</strong>r pr<strong>of</strong>its to<br />

£20 Scots and 24 bolls <strong>of</strong> oatmeal <strong>of</strong> <strong>the</strong> measure <strong>of</strong> Nytht (Nith) ; to<br />

be held <strong>of</strong> <strong>the</strong>m and <strong>the</strong>ir successors in feufarm and heritage for ever,<br />

paying yearly for <strong>the</strong> multures, &c. £20 Scots and 24 bolls <strong>of</strong> oatmeal<br />

and 3 merkw in augmentation <strong>of</strong> rental at two terms, <strong>the</strong> purification <strong>of</strong><br />

<strong>the</strong> Virgin Mary and St. Peter ad vincula ; and <strong>the</strong> heirs paying a<br />

duplicand at entry. Contains clause <strong>of</strong> warrandice. Dated at <strong>the</strong><br />

Monastery <strong>of</strong> Holy wood 1558. No day, month, nor witnesses. Subscribed<br />

by <strong>the</strong> same abbot and friars as <strong>the</strong> precept foregoing, except<br />

John Lytill. [Seal wanting.]<br />

This was followed by a precept <strong>of</strong> sasine, <strong>of</strong> same date, subscribed by<br />

<strong>the</strong> same persons, directed to James Maxwell <strong>of</strong> Porterrak. <strong>The</strong> common<br />

seal is said to be affixed. [Seal remaining, but figures obliterated. <strong>The</strong><br />

inscription seems to read "s. monasterii sacri nemoris." A<br />

commission was issued by John, Archbishop <strong>of</strong> St. Andrews, Primate<br />

<strong>of</strong> <strong>Scotland</strong>, and Legate <strong>of</strong> <strong>the</strong> Apostolic See, with power <strong>of</strong> a legate a<br />

latere, directed to <strong>the</strong> abbot <strong>of</strong> Swee<strong>the</strong>art Abbey, <strong>of</strong> <strong>the</strong> Order <strong>of</strong> St.<br />

Augustine, <strong>of</strong> Glasgow diocese, and to <strong>the</strong> Prior, subprior, and archdeacon<br />

<strong>of</strong> <strong>the</strong> Church <strong>of</strong> Whithorn, <strong>of</strong> <strong>the</strong> Premonstratensian order,<br />

directing <strong>the</strong>m to make inquiries and if <strong>the</strong> sale was found for <strong>the</strong> good<br />

<strong>of</strong> <strong>the</strong> church to confirm it by Apostolical authority, a petition to that<br />

effect having been presented to him by John, Lord Maxwell. Dated at<br />

Edinburgh <strong>of</strong> St. Andrews diocese, 28 May, 1558. At <strong>the</strong> foot <strong>of</strong> <strong>the</strong><br />

document are signatures <strong>of</strong> " A Forrest sec," "Datarius," " F. Petrus,"<br />

" T. Blac Abbt^'^" [Only half <strong>of</strong> skippet remaining.].<br />

Sasine was given to John, Lord Maxwell, 4 April, 1576, on <strong>the</strong><br />

precept which is ingrossed and <strong>the</strong> day and month given 20 April 1558,<br />

and witnesses inserted which are blank in <strong>the</strong> original precept.<br />

178. Tack or Lease by Thomas, Commendator <strong>of</strong> <strong>the</strong> Abbey <strong>of</strong><br />

Holywood, for divers great sums <strong>of</strong> money paid in name <strong>of</strong> grassums<br />

which had been all applied to <strong>the</strong> benefit and weal <strong>of</strong> <strong>the</strong> Abbot and his<br />

Abbey, with consent <strong>of</strong> his convent, letting to John Maitland <strong>of</strong><br />

Auchingaschill, Dorathie Johnstoun his spouse, and Robert Maitland,<br />

<strong>the</strong>ir son, for <strong>the</strong>ir lifetimes &c., and for nineteen years, <strong>the</strong> tcind<br />

sheaves <strong>of</strong> <strong>the</strong> whole lands in <strong>the</strong> parishes <strong>of</strong> Penpont and Tynrouu<br />

pertaining to him as parts and pertinents <strong>of</strong> <strong>the</strong> Abbey, <strong>the</strong>ir entry to<br />

be at date, for <strong>the</strong> yearly sum <strong>of</strong> 28 merks 6 s 8 d Scots, at two terms<br />

Candlemas and Lammas, for <strong>the</strong> teind sheaves <strong>of</strong> lands in <strong>the</strong> parishes<br />

which are now in <strong>the</strong> said persons ow^n hands, viz., Auchingaschill,<br />

Auchinbanze, Clawquhanholme, 100 s. land <strong>of</strong> Bagrawis, Auchinfa<strong>the</strong>,<br />

Tibberstoun, Messingeris lands, " to wit, <strong>the</strong> layrd Amvligane and <strong>the</strong><br />

laird Makcallis lands," Cioyngavies, &c., <strong>the</strong> 40 s. land <strong>of</strong> Penpont and<br />

Grenane, &c. And as <strong>the</strong>re were o<strong>the</strong>r persons who had tacks <strong>of</strong> teinds<br />

on terms yet to run in <strong>the</strong> same parishes, at <strong>the</strong> issue <strong>of</strong> <strong>the</strong> said tacks,..
