late Symon Carru<strong>the</strong>ris <strong>of</strong> JVIouswall, in <strong>the</strong> said lands <strong>of</strong> Cumlonganewod,<br />

held immediately <strong>of</strong> <strong>the</strong> lairds <strong>of</strong> CokpuU free blench, for payment<br />

yearly <strong>of</strong> a red ros^ at <strong>the</strong> feast <strong>of</strong> St. John <strong>the</strong> Baptist, in name <strong>of</strong><br />

blench ferm, &c., and to cause her retour be past <strong>the</strong> chancery, and in<br />

her name receive infeftment <strong>of</strong> <strong>the</strong> lands, to resign <strong>the</strong> lands in <strong>the</strong><br />

laird <strong>of</strong> CokpuU's hands as superior. And she hereby renounces and<br />

resigns <strong>the</strong> said lands in favour <strong>of</strong> Sir James Douglas <strong>of</strong> Drumlanrig,<br />

knight, his heirs and assignees, for infeftment to be given to him.<br />

Dated at Drumlanrig, 22 January 1607. Witnesses, Mr. John Douglas<br />

<strong>of</strong> Arkland, William Irving <strong>of</strong> Bonschaw, and o<strong>the</strong>rs. Jonet Carru<strong>the</strong>ris<br />

signs with her hand at <strong>the</strong> pen.<br />

127. In <strong>the</strong> Drumlanrig charter chest <strong>the</strong>re is a MS. Protocol Book<br />

<strong>of</strong> Mark Carru<strong>the</strong>ris, presbyter <strong>of</strong> St. Andrew's diocese, and notary<br />

public (Dumfries). <strong>The</strong> entries in this book begin on <strong>the</strong> 17th October<br />

1531 with <strong>the</strong> induction <strong>of</strong> Thomas Erskyne to <strong>the</strong> rectory <strong>of</strong><br />

Lochtmaban. <strong>The</strong>y end with a sasine <strong>of</strong> Kentigern (Muugo) Maxwell,<br />

bro<strong>the</strong>r <strong>of</strong> Edward Maxwell <strong>of</strong> Mylhil, in six acres <strong>of</strong> land <strong>of</strong> Mylhil, in<br />

<strong>the</strong> parish <strong>of</strong> Traqueir and sheriffdom <strong>of</strong> Kirkcudbrycht, dated 18<br />

February 1561-2. During <strong>the</strong> long period <strong>of</strong> thirty years in which<br />

Mark Carru<strong>the</strong>rs exercised his pr<strong>of</strong>ession <strong>of</strong> a notary public, he appears<br />

to have been well employed by <strong>the</strong> inhabitants <strong>of</strong> Dumfries, and also by<br />

owners <strong>of</strong> adjacent properties, in recording <strong>the</strong> acquisitions and transmissions<br />

<strong>of</strong> heritable property in that burgh and also in Lochmaben and<br />

neighbourhood.<br />

Head Eighth.—Ancient Miscellaneous Charters by <strong>the</strong> Earls <strong>of</strong><br />

Crawford and Lord Lindsay and o<strong>the</strong>r owners <strong>of</strong> landed property,<br />

relating to lands in <strong>the</strong> counties <strong>of</strong> Dumfries and Lanark.<br />

This section includes a list <strong>of</strong> <strong>the</strong> Weaponshaw <strong>of</strong> Annandale, held on<br />

Birrenswark hill in <strong>the</strong> year 1541. Among o<strong>the</strong>r ecclesiastical writs it<br />

contains two ; <strong>the</strong> first is one by Robert Stewart, natural son <strong>of</strong> King<br />

James <strong>the</strong> Fifth, commendator <strong>of</strong> <strong>the</strong> monastery <strong>of</strong> Holyrood, near<br />

Edinburgh, being a precept <strong>of</strong> sasine for a tenement in Edinburgh.<br />

<strong>The</strong> second is a dispensation by John Hamilton, archbishop <strong>of</strong> St.<br />

Andrews, for a marriage <strong>of</strong> James Twedy and Jonet Douglas, whose<br />

marriage was hindered by <strong>the</strong> somewhat unusual impediment <strong>of</strong> spiritual<br />

cognition (impedimento cognitionis spiritualis) . This cognition arose<br />

out <strong>of</strong> <strong>the</strong> fact that Jonet's fa<strong>the</strong>r had lifted James her proposed<br />

husband from <strong>the</strong> sacred font. A fourth degree <strong>of</strong> consanguinity was<br />

also involved. <strong>The</strong> archbishop, as legate, dispensed with <strong>the</strong> impediment<br />

and allowed <strong>the</strong> marriage to proceed.<br />

<strong>The</strong> writs under this head date from <strong>the</strong> year 1449 to 1569.<br />

128. Charter by Alexander Earl <strong>of</strong> Oaufurd and Lord <strong>of</strong> Lindesay,<br />

granting to his dearest cousin, John <strong>of</strong> Hammyltoun, bro<strong>the</strong>r gerraan <strong>of</strong><br />

James, Lord le Hammyltoun,' for his most grateful help, counsel and<br />

service, <strong>of</strong>ten done to <strong>the</strong> Earl's progenitor, and to be done, <strong>the</strong> lands<br />

<strong>of</strong> Quhite Camp and Kirkop, in <strong>the</strong> lordship <strong>of</strong> Craufurd Lindesay and<br />

sheriffdom <strong>of</strong> Lanark, and in exchange for <strong>the</strong> lands^<strong>of</strong> Westir Brichti,<br />

in his barony <strong>of</strong> Feme, and sheriffdom <strong>of</strong> Forfare ; to be held by him<br />

and his heirs whomsoever, in name <strong>of</strong> excambion, for <strong>the</strong> lands <strong>of</strong> Westir<br />

Brichti, <strong>of</strong> <strong>the</strong> Earl, his heirs and successors, in fee and heritage; and<br />

notwithstanding any previous entail &c. for services due and wont^
