ARTICLE 9<br />
TIME<br />
9.1 Notice to Proceed<br />
9.1.1 Contract time shall commence on the date <strong>of</strong> receipt, by the Contractor <strong>of</strong> a written Notice to Proceed,<br />
issued by the Contracting Officer. Notice to proceed shall be promptly issued by the <strong>College</strong> after receipt and<br />
acceptance, by the Contracting Officer, <strong>of</strong> properly executed contract documents including performance and payment<br />
bonds. The Contractor agrees that contract site work shall commence no later than ten (10) calendar days after receipt <strong>of</strong><br />
the notice to proceed.<br />
9.1.2. Provided the contract is not terminated pursuant to the paragraph contained within the Instructions to<br />
Bidders, entitled "Contract and Bonds", if in the opinion <strong>of</strong> the Contracting Officer, the Contractor's delay in furnishing<br />
financial responsibility and performance or payment bonds causes a delay in the issuance <strong>of</strong> the Notice to Proceed, the<br />
time to complete the work as specified in the contract may be reduced to reflect such delay.<br />
9.1.3 The Contractor shall perform no work under this contract until the required evidence <strong>of</strong> financial<br />
responsibility and bonds have been furnished. Thereafter, work at other than the contract site may be undertaken. The<br />
Contractor shall perform no work at the contract site except pursuant to a Notice to Proceed given by the Contracting<br />
Officer.<br />
9.1.4 Notice to Proceed may be issued by the <strong>College</strong> at its convenience. Any right <strong>of</strong> the Contractor to an<br />
adjustment because <strong>of</strong> a delay in issuing a Notice to Proceed shall be determined in accordance with the Article entitled<br />
"Contracting Officer's Right to Stop Work."<br />
9.2 Critical Path Method Scheduling<br />
9.2.1 The Contractor shall be responsible for preparing and furnishing to the Contracting Officer through<br />
the Construction Manager, thirty (30) calendar days after the issuance <strong>of</strong> the Notice to Proceed, a coordinated Critical<br />
Path Method baseline schedule.<br />
9.2.2 The Critical Path Method schedule based upon the Contractor's logic and time estimates shall<br />
indicate, in suitable detail for display, all significant features <strong>of</strong> the Work, including the placing <strong>of</strong> orders and anticipated<br />
delivery dates for critical items, submissions and approvals <strong>of</strong> Shop Drawings, all work activities to be performed by<br />
each Subcontractor and the beginning and time durations there<strong>of</strong> and the dates <strong>of</strong> substantial and final completion <strong>of</strong> the<br />
various branches <strong>of</strong> the Work.<br />
9.2.3 The Contractor shall furnish sufficient labor, construction plant and equipment to insure the<br />
prosecution <strong>of</strong> the Work in accordance with the Critical Path Method schedule. If the latest completion time for any<br />
significant job does not come within the time allowed by the Schedule, the sequence <strong>of</strong> jobs and/or the time for<br />
performance <strong>of</strong> jobs shall be revised by the Contractor through concurrent operations, additional manpower, additional<br />
shifts, overtime, etc., until it is assured that the Contract Completion Date will be met. No additional charges to the<br />
<strong>College</strong> will be allowed for overtime, additional manpower, equipment, additional shifts, etc., (except as may be<br />
provided elsewhere in the Contract) if such expediting procedures or measures are necessary to meet the agreed<br />
completion date.<br />
9.2.4 The Contractor agrees that he will make no claim for, and have no right to, additional payment or<br />
extension <strong>of</strong> time for completion <strong>of</strong> the Work, or any other concession because <strong>of</strong> any misinterpretation or<br />
misunderstanding on its part <strong>of</strong> the Critical Path Method schedule, or because <strong>of</strong> any failure on its part to fully acquaint<br />
himself with all conditions relating to the Schedule and the manner in which it will be used on the <strong>Project</strong> or to perform<br />
its contract in accordance with the schedule.<br />
9.2.5 Within ten (10) calendar days after receipt <strong>of</strong> the initial Critical Path Method schedule, the <strong>College</strong>'s<br />
