ARTICLE 14<br />

CHANGES IN THE WORK<br />

14.1 Changes to Contract<br />

14.1.1 The Contracting Officer may, at any time, by written order designated or indicated to be a change<br />

order, make any change in the work within the general scope <strong>of</strong> the contract, including but not limited to, changes:<br />

(1) In the specifications (including drawings and designs);<br />

(2) In the method or manner <strong>of</strong> performance <strong>of</strong> the work;<br />

(3) In the <strong>College</strong> furnished facilities, equipment, materials, services, or site;<br />

or<br />

(4) Directing acceleration in the performance <strong>of</strong> the work.<br />

14.2 Processing <strong>of</strong> Contractor Requests for Equitable Adjustment<br />

14.2.1 Notwithstanding any other Article <strong>of</strong> this contract, any time extensions for changes in the work<br />

depend upon the extent, if any, by which the changes cause delay in the completion <strong>of</strong> the various elements <strong>of</strong><br />

construction. The contract modification making such time extension will provide for an extension <strong>of</strong> contract completion<br />

date only for those specific elements so delayed and will not alter the contract completion dates for other portions <strong>of</strong> the<br />

work. This contract modification may further provide for an equitable readjustment <strong>of</strong> liquidated damages pursuant to<br />

the new completion schedule.<br />

14.2.2 The Contractor, in connection with any request he makes for an equitable adjustment, shall furnish a<br />

price breakdown, itemized as required by the Contracting Officer. Unless otherwise directed, the breakdown shall cover<br />

all work involved in the change whether such work was deleted, added or changed. The breakdown shall be in sufficient<br />

detail to permit an analysis <strong>of</strong> all material, labor, equipment, subcontract, and overhead costs, as well as pr<strong>of</strong>it. Any<br />

amount proposed for subcontracts shall be supported by a similar price breakdown. In addition, if the request includes a<br />

time extension, a justification shall also be furnished. The request, together with the price breakdown and time<br />

extension justification, shall be furnished by the date specified. It is the Contractor’s responsibility to include all direct<br />

and indirect work related to a change in the request. If the Contractor fails to identify work in the request that is later<br />

discovered as a result <strong>of</strong> the change, the work will be completed at no additional cost to the <strong>College</strong>.<br />

14.2.3 If any change under this Article causes an increase or decrease in the Contractor's cost <strong>of</strong>, or the time<br />

required for, the performance <strong>of</strong> any part <strong>of</strong> the work under this contract, whether or not changed by any such order, an<br />

equitable adjustment shall be made in the contract price or delivery schedule or both and the contract modified in writing<br />

within three (3) days <strong>of</strong> discovery <strong>of</strong> the change. If a change is submitted for work performed without prior notification,<br />

the <strong>College</strong> is not responsible for the cost <strong>of</strong> the change since the avoidance <strong>of</strong> such costs was not afforded to the<br />

<strong>College</strong>.<br />

14.2.4 Contractor change order requests are to be submitted for approval by the <strong>College</strong> and shall include the<br />

following components:<br />

1. Direct Materials – Direct material costs shall consist <strong>of</strong> actual cost <strong>of</strong> materials purchased by the<br />

Contractor. Contractors are to list all materials with quantities and unit prices along with bill <strong>of</strong><br />

sale from the applicable vendor.<br />

2. Direct Equipment – Rental and operating costs for equipment only, either rented or owned, by<br />

the Contractor. The equipment shall be listed with quantity <strong>of</strong> hours and hourly rate. Costs for<br />
