9.2.8 In addition to the foregoing, once each month the Contractor will provide a<br />

narrative report to the <strong>College</strong>. The narrative report will include a description <strong>of</strong> the amount <strong>of</strong><br />

progress during the last month in terms <strong>of</strong> completed activities in the plan currently in effect, a<br />

description <strong>of</strong> problem areas, current and anticipated delaying factors and their estimated impact on<br />

the performance <strong>of</strong> other activities and completion dates, and recommendations on corrective action<br />

for the Contractor. Within seven (7) days after receipt <strong>of</strong> this report, the Contractor shall submit to<br />

the <strong>College</strong>, in writing, an explanation <strong>of</strong> corrective action taken or proposed. The Contracting<br />

Officer, after reviewing the written submissions, shall make a decision binding on all parties.<br />

9.2.9 The monthly submission <strong>of</strong> the computer-produced calendar-dated schedule shall<br />

be an integral part and basic element <strong>of</strong> the estimate upon which progress payments shall be made<br />

pursuant to the provisions <strong>of</strong> "Payment", Article 10 <strong>of</strong> these General Conditions. The Contractor<br />

shall be entitled to progress payments only upon receipt by the <strong>College</strong> <strong>of</strong> an updated CPM schedule.<br />

9.2.10 The Contractor agrees that whenever it becomes apparent from the current monthly<br />

schedule that any Contract Completion Date will not be met, he will take some or all <strong>of</strong> the following<br />

actions at no additional cost to the <strong>College</strong>:<br />

(1) Increase construction manpower in such trades and numbers as will<br />

substantially eliminate, in the judgment <strong>of</strong> the Contracting Officer, the<br />

backlog <strong>of</strong> work;<br />

(2) Increase the number <strong>of</strong> working hours per shift, shifts per working day,<br />

working days per week, or the amount <strong>of</strong> construction equipment, or any<br />

combination <strong>of</strong> the foregoing sufficiently to substantially eliminate, in the<br />

judgment <strong>of</strong> the Contracting Officer, the backlog <strong>of</strong> work; and/or<br />

(3) Reschedule activities to achieve maximum practical concurrence <strong>of</strong><br />

accomplishment <strong>of</strong> activities.<br />

9.3 Adjustment <strong>of</strong> Contractor Completion Time<br />

9.3.1 The Contract completion time or times will be adjusted only for causes specified in<br />

this Contract. In the event a Contractor requests an extension <strong>of</strong> any Contract Completion Date, he<br />

shall furnish such justification and supporting evidence that the <strong>College</strong> or the Architect/Engineer<br />

requires to evaluate the Contractor's request. The Contracting Officer shall then make its finding <strong>of</strong><br />

fact and advise the Contractor in writing there<strong>of</strong>. If the Contracting Officer finds that the Contractor<br />

is entitled to any extension <strong>of</strong> any Contract Completion Date under the provisions <strong>of</strong> this Contract, the<br />

determination as to the total number <strong>of</strong> days extension shall be based upon the currently approved<br />

computer-produced calendar-dated schedule and on all data relevant to the extension. Such data will<br />

be included in the next updating <strong>of</strong> the schedule.<br />

9.3.2 Two (2) types <strong>of</strong> time extensions may be issued for this project as follows:<br />

(1) A total project time extension may be issued if delays which are<br />

determined to be beyond the control <strong>of</strong> the Contractor affect the main<br />

project critical path shown on the CPM Schedule thereby directly<br />

extending the final project completion date.<br />

(2) A concurrent project time extension may be issued in those instances<br />

where it is found that specific delays beyond the control <strong>of</strong> the Contractor<br />

would have affected the final project completion date were it not for<br />

overriding delays due to other causes. If a concurrent project time<br />

extension is issued, it will over that time which, according to the CPM<br />
