Drawings, Product Data, Samples or similar submittals unless the Contractor has specifically informed the<br />

Construction Manager and Architect in writing <strong>of</strong> such deviation at the time <strong>of</strong> submittal and (1) the Architect has<br />

given written approval to the specific deviation as a minor change in the Work, or (2) a Change Order or<br />

Construction Change Directive has been issued authorizing the deviation. The Contractor shall not be relieved <strong>of</strong><br />

responsibility for errors or omissions in Shop Drawings, Product Data, Samples or similar submittals by the<br />

Architect’s approval there<strong>of</strong>. Should a deviation not be clearly identified in the submittal and the submittal is<br />

approved by the Architect and/or Engineer and the work is put in place, the Contractor will be responsible to<br />

remove, replace, and/or correct the work in place at no additional cost to the <strong>College</strong> to adhere to the contract<br />

documents.<br />

4.10.9 The Contractor shall direct specific attention, in writing or on resubmitted Shop Drawings, Product<br />

Data, Samples or similar submittals, to revisions other than those requested by the Construction Manager and<br />

Architect on previous submittals. In the absence <strong>of</strong> such written notice, the Architect’s approval <strong>of</strong> a resubmission<br />

shall not apply to such revisions.<br />

4.10.10 The Contractor shall not be required to provide pr<strong>of</strong>essional services that constitute the practice <strong>of</strong><br />

architecture or engineering unless such services are specifically required by the Contract Documents for a portion <strong>of</strong><br />

the Work or unless the Contractor needs to provide such services in order to carry out the Contractor’s<br />

responsibilities for construction means, methods, techniques, sequences and procedures. The Contractor shall not be<br />

required to provide pr<strong>of</strong>essional services in violation <strong>of</strong> applicable law. If pr<strong>of</strong>essional design services or<br />

certifications by a design pr<strong>of</strong>essional related to systems, materials or equipment are specifically required <strong>of</strong> the<br />

Contractor by the Contract Documents, the <strong>College</strong> and the Architect will specify all performance and design criteria<br />

that such services must satisfy. The Contractor shall cause such services or certifications to be provided by a<br />

properly licensed design pr<strong>of</strong>essional, whose signature and seal shall appear on all drawings, calculations,<br />

specifications, certifications, Shop Drawings and other submittals prepared by such pr<strong>of</strong>essional. Shop Drawings and<br />

other submittals related to the Work designed or certified by such pr<strong>of</strong>essional, if prepared by others, shall bear such<br />

pr<strong>of</strong>essional’s written approval when submitted to the Architect. The <strong>College</strong> and the Architect shall be entitled to<br />

rely upon the adequacy, accuracy and completeness <strong>of</strong> the services, certifications and approvals performed or<br />

provided by such design pr<strong>of</strong>essionals, provided the <strong>College</strong> and Architect have specified to the Contractor all<br />

performance and design criteria that such services must satisfy. The Architect will review, approve or take other<br />

appropriate action on submittals only for the limited purpose <strong>of</strong> checking for conformance with information given<br />

and the design concept expressed in the Contract Documents. The Contractor shall not be responsible for the<br />

adequacy <strong>of</strong> the performance and design criteria specified in the Contract Documents.<br />

4.10.<strong>11</strong> Submittal Schedules shall be prepared and incorporated into the Contractor’s Construction<br />

Schedule. The Contractor shall include the following considerations when preparing the submittal schedule so that<br />

approved products are at the project site ready for installation in accordance with the time established in the<br />

Contractor’s Construction Schedule to avoid delays.<br />

a) Time frame when the item is needed at the <strong>Project</strong>.<br />

b) Time necessary to produce the product.<br />

c) Lead time required to prepare the submittal.<br />

d) Time required for the Contractor to review, approve, sign and date the submittal.<br />

e) Time for the Construction Manager, the Architect and his Engineer to review the submittal.<br />

f) The number <strong>of</strong> Subcontractor’s affected by the information contained in the submittal.<br />

g) Time necessary to correct and resubmit if original submittal is not approved.<br />

h) Submittal <strong>of</strong> all color samples within adequate time for review, selection and coordination with other<br />

products requiring earlier installation and/or longer lead times for ordering.<br />

i) Grouping <strong>of</strong> related submittals for coordination.<br />

4.10.12 Submittals shall contain a Contractor’s stamp <strong>of</strong> approval, signed and dated by the submitting<br />

Contractor, prior to submission to the Architect/Engineer. Such stamp <strong>of</strong> approval by the Contractor shall be<br />

confirmation that he has determined and verified materials, field measurements and field construction criteria related<br />

thereto, and has checked and coordinated the information contained within such submittals. The Contractor shall<br />

also note in writing to the Architect/Engineer, all deviations to the Contract Documents. Submittals will not be<br />
