intended use even though all permanent installations are not in place. The determination as to the date <strong>of</strong> substantial<br />

completion shall be made pursuant to Article 10.4 <strong>of</strong> the General Conditions.<br />

1.1.27 "Systems Assurance" shall mean the totality <strong>of</strong> all quality control and assurance requirements<br />

specified in the contract documents.<br />

1.1.28 "Unit Schedule Breakdown" comprises a detailed list <strong>of</strong> the work activities required for project<br />

construction, other elements associated with fulfilling the requirements <strong>of</strong> the Contract (bonds, insurance, etc.), major<br />

items <strong>of</strong> material or equipment and the prices associated therewith.<br />

1.1.29 The term "Work" as used herein comprises all construction efforts required by the Contract<br />

Documents and includes all supervision, labor, material and equipment necessary to complete such construction.<br />

1.2 Intent <strong>of</strong> the Contract<br />

1.2.1 The Drawings and Specifications <strong>of</strong> the Contract are intended to require the Contractor to provide for<br />

everything reasonably necessary to accomplish the proper and complete finishing <strong>of</strong> the work. All Work and Materials<br />

included in the Specifications and not shown on the Drawings, or shown on the Drawings and not in the Specifications,<br />

shall be performed by the Contractor as if described in both. Any incidental material, and/or work not specified in the<br />

Drawings and/or the Specifications which is, nevertheless, necessary for the true development there<strong>of</strong> and reasonably<br />

inferable therefrom, the Contractor shall understand the same to be implied and required, and he shall perform all such<br />

Work and furnish all such materials as if particularly delineated or described therein at no additional cost to the <strong>College</strong>.<br />

Should there be an obvious error or omission in the Drawings or Specifications, it shall be the Contractor's responsibility<br />

to complete the Work as reasonably required at no additional cost to the <strong>College</strong>, consistent with the intent <strong>of</strong> such<br />

Drawings and Specifications as may be interpreted by the Contracting Officer or authorized representative.<br />

1.2.2 Each Contractor shall abide by and comply with the true intent and meaning <strong>of</strong> the Drawings, the<br />

Specifications and other Contract Documents taken as a whole, and shall not avail himself <strong>of</strong> any unintentional error or<br />

omission, should any exist. Should any error, omission or discrepancy appear, or should any doubt exist, or any dispute<br />

arise as to the true intent and meaning <strong>of</strong> the Drawings, the Specifications or other Contract Documents, or should any<br />

portion there<strong>of</strong> be obscure, or capable <strong>of</strong> more than one interpretation, the Contractor shall immediately notify the<br />

Contracting Officer and seek correction or interpretation there<strong>of</strong> prior to commencement <strong>of</strong> affected Work. The<br />

Contracting Officer or authorized representative shall issue its written Interpretation with reasonable promptness.<br />

However, the Contractor shall make no claim against the <strong>College</strong> for expenses incurred or damages sustained on account<br />

<strong>of</strong> any error, discrepancy, omission or conflict in the Contract Documents.<br />

1.2.3 Each and every provision required by law to be inserted in the Contract Documents shall be deemed<br />

to have been inserted therein. If any such provision has been omitted or has not been correctly inserted, then upon<br />

application <strong>of</strong> either party, the Contract shall be physically amended to provide for such insertion or correction.<br />

1.2.4 The organization <strong>of</strong> the Specifications into Divisions, Sections and Articles, and the arrangement <strong>of</strong><br />

Drawings shall not be construed by the Contractor as being intended to divide or allocate the Work among<br />

Subcontractors in any manner or to establish the extent <strong>of</strong> the work to be performed by any trade. The Contractor is<br />

solely responsible for allocation <strong>of</strong> the contracted work to each Subcontractor regardless if a trade designation is made in<br />

the Contract Documents.<br />

1.2.5 The Contracting Officer will furnish to the Contractor one electronic copy <strong>of</strong> the Contract Documents.<br />

1.2.6 The Contractor shall do no Work without proper Drawings and instructions unless authorization to<br />

proceed from the Contracting Officer or an authorized representative is received by the Contractor, in writing.<br />

1.2.7 All Drawings referred to, together with such supplementary details as may be furnished and approved<br />

from time to time as the Work progresses, are understood as being included as part <strong>of</strong> the Contract to which they relate.<br />
