shall be provided and accomplished at no cost to the <strong>College</strong>.<br />

4.4 Responsibility for the Work<br />

4.4.1 The Contractor shall be responsible to the Contracting Officer for the acts and omissions <strong>of</strong> its<br />

employees, subcontractors and their agents and employees which injure, damage or delay such other contractors in the<br />

performance <strong>of</strong> their Work. This responsibility is not limited by the applicable provisions stated elsewhere herein, but is<br />

in conjunction with, and related thereto.<br />

4.4.2 The Contractor shall be responsible for all damage or destruction caused directly or indirectly by its<br />

operations, to all parts <strong>of</strong> the Work, both temporary and permanent, and to all adjoining property.<br />

4.4.3 The Contractor shall, at its own expense, protect all finished Work liable to damage and keep the<br />

same protected until the project is completed and accepted. In the case <strong>of</strong> Substantial Completion accompanied by<br />

Beneficial Occupancy by the <strong>College</strong> the Contractor's obligation to protect its finished Work shall cease simultaneously<br />

with the occupancy <strong>of</strong> the portion or portions <strong>of</strong> the structure.<br />

4.4.4 The Contractor shall defend, protect, indemnify and save harmless the <strong>College</strong> and its authorized<br />

representatives from all claims, fines, penalties, suits, actions, damages and costs <strong>of</strong> every name and description arising<br />

out <strong>of</strong>, or resulting from, the performance <strong>of</strong> its Work under this Contract. This responsibility is not limited by the<br />

provisions <strong>of</strong> other indemnification provisions included elsewhere herein.<br />

4.4.5 In order to protect the lives and health <strong>of</strong> its employees, the Contractor shall comply with all<br />

applicable statutes and pertinent provisions <strong>of</strong> the "<strong>Manual</strong> <strong>of</strong> Accident Prevention in Construction" issued by the<br />

Associated General Contractors <strong>of</strong> America, Inc., and shall maintain an accurate record <strong>of</strong> all cases <strong>of</strong> death,<br />

occupational disease, and injury requiring medical attention or causing loss <strong>of</strong> time from work, arising out <strong>of</strong> and in the<br />

course <strong>of</strong> employment on work under the Contract. The Contractor alone shall be responsible for the safety, efficiency,<br />

and adequacy <strong>of</strong> its plant, appliances and methods, and for any damage or injury which may result from its failure or its<br />

improper construction, maintenance or operation.<br />

4.5 Permits-Laws-Regulations<br />

4.5.1 The Contractor shall secure and pay for all permits, governmental fees, and licenses necessary for the<br />

proper execution and completion <strong>of</strong> the Work and which are legally required at the time <strong>of</strong> receipt <strong>of</strong> bids except for<br />

construction permits and inspections by <strong>New</strong> <strong>Jersey</strong> Department <strong>of</strong> Community Affairs.<br />

4.5.2 All work defined in this Contract is to be done in accordance with the <strong>New</strong> <strong>Jersey</strong> Uniform<br />

Construction Code. No work requiring inspections and approval <strong>of</strong> construction code <strong>of</strong>ficials is to be covered or<br />

enclosed prior to inspection and approval by appropriate code enforcement <strong>of</strong>ficials.<br />

4.5.3 The Work under this Contract is exempt from local ordinances, codes and regulations as related to the<br />

building and the site on which it is located, except where construction could adversely affect adjacent property, public<br />

sidewalks and/or streets. The Contractor shall coordinate its activities with municipal and/or highway authorities having<br />

appropriate jurisdiction.<br />

4.5.4 Soil conservation measures are to be in accordance with County Soil Conservation District<br />

requirements.<br />

4.5.5 All sewage disposal work shall conform with the regulations <strong>of</strong> the State Department <strong>of</strong><br />

Environmental Protection.<br />

4.5.6 The <strong>College</strong> will pay for all <strong>New</strong> <strong>Jersey</strong> Department <strong>of</strong> Community Affairs code inspection; however,<br />

it is the Contractor's responsibility to request inspections as required to continue progress <strong>of</strong> the Work in accordance<br />

with the construction schedule.<br />
