ARTICLE 3<br />
CONSTRUCTION MANAGER<br />
AND<br />
ARCHITECT / ENGINEER<br />
3.1 Construction Manager and Architect / Engineer<br />
3.1.1 The <strong>College</strong> may engage a Construction Management firm (Construction Manager) to act as the<br />
<strong>College</strong>’s authorized representative, without assuming any <strong>of</strong> the Architect/Engineer’s contractual,<br />
statutory, or customary obligations. The Construction Manager will provide general administration<br />
and construction management services for the project; and act as a liaison between the <strong>College</strong>, the<br />
Architect/Engineer, and the Contractor.<br />
The Construction Management Firm is responsible for providing construction management<br />
services, as described in the Construction Management Agreement, for all contracts entered into by<br />
the <strong>College</strong>, including those relative to the construction and monitoring <strong>of</strong> the CPM Scheduling <strong>of</strong><br />
the <strong>Project</strong> and all <strong>of</strong> its parts. The Construction Management Firm shall become fully familiar<br />
with the contractual obligations <strong>of</strong> all entities doing work on the <strong>Project</strong> and all relevant <strong>Project</strong><br />
documentation, including the design documents prepared by the Architect/Engineer, in order to<br />
confirm that the Contractor completes the <strong>Project</strong> in accordance with its contractual obligations<br />
and the <strong>College</strong>’s objectives for cost, time, and quality.<br />
3.1.2 When the <strong>College</strong> provides a Construction Manager, the role <strong>of</strong> the Architect/Engineer is that <strong>of</strong><br />
Consultant to the <strong>College</strong> and will provide general administration services for the project.<br />
3.1.3 When the <strong>College</strong> does not provide a Construction Manager, the role <strong>of</strong> the Architect/Engineer is to<br />
provide general administration and construction management services for the project.<br />
3.2 Administration <strong>of</strong> the Contract<br />
3.2.1 The Architect/Engineer and the Construction Manager will provide administration <strong>of</strong> the Contract, as<br />
hereinafter described.<br />
3.2.2 The Construction Manager and the Architect/Engineer will monitor the execution and progress <strong>of</strong> the<br />
Work and will immediately notify the <strong>College</strong> <strong>of</strong> any related problems. The Architect/Engineer and the Construction<br />
Manager will at all times be provided access to the Work. The Contractor shall provide facilities for such access so as to<br />
enable the Construction Manager and the Architect/Engineer to perform their functions under the Contract Documents.<br />
3.2.3 The Construction Manager and/or the Architect/Engineer will not be responsible for, nor will they<br />
have control or charge <strong>of</strong>, construction means, methods, techniques, sequences <strong>of</strong> procedures, or safety precautions and<br />
programs in connection with the Work. The Construction Manager and/or the Architect/Engineer will not be<br />
responsible for, nor have control or charge over, the acts or omissions <strong>of</strong> the Contractor, Subcontractors, or any <strong>of</strong> their<br />
agents or employees, or any other person performing any <strong>of</strong> the Work, but shall have the obligation to immediately<br />
inform the Contracting Officer <strong>of</strong> any inadequate performance on the project.<br />
3.2.4 The Construction Manager, after consultation with the Architect/Engineer, will recommend the<br />
rejection <strong>of</strong> Work which he believes does not conform to the Contract Documents. Whenever, in its opinion, he<br />
considers it necessary or advisable, he may request the Contracting Officer to provide special inspection or testing <strong>of</strong> the<br />
Work, whether or not such Work has been fabricated, installed or completed.<br />
3.2.5 The Construction Manager shall record, track, and if required, set procedures for the processing <strong>of</strong><br />
Contractor submittals. The Architect/Engineer, will review, approve or take other appropriate action relating to<br />
Contractor's submittals, such as Shop Drawings, Product Data and Samples, to assure conformance with the design<br />
