4.5.7 Consistent with Subparagraph 4.4.4, the Contractor shall be responsible for and save harmless the<br />

<strong>College</strong> and its authorized representatives from all fines, penalties or loss incurred for, or by reason <strong>of</strong>, the violation <strong>of</strong><br />

any ordinance or regulation or law <strong>of</strong> the State while the said Work is in process <strong>of</strong> construction.<br />

4.5.8 The Contractors shall comply with the Federal Occupational Safety and Health Act <strong>of</strong> 1970 and all <strong>of</strong><br />

the rules and regulations promulgated there under and NJ Worker and Community Right to Know Act (PL1983 c. 315<br />

N.J.S.A. 34:5A-1, et seq).<br />

4.5.9 As a result <strong>of</strong> a finding, by an appropriate Finder <strong>of</strong> Fact, that a Contractor caused a substantial<br />

violation <strong>of</strong> a State, local or federal statute or regulation on said project, the <strong>College</strong> may declare the Contractor to be in<br />

default.<br />

4.5.10 Prior to the start <strong>of</strong> any crane equipment operations, each Contractor shall make all necessary<br />

applications and obtain all required permits from the Federal Aviation Administration (F.A.A.). The Sequence <strong>of</strong><br />

operations, timing and methods <strong>of</strong> conducting the work shall be approved by the F.A.A. to the extent that it relates to<br />

their jurisdiction.<br />

4.6 Storage, Cleaning and Final Clean Up<br />

4.6.1 The Contractor shall confine its apparatus, the storage <strong>of</strong> its equipment, tools and materials, and its<br />

operations and workmen to areas permitted by law, ordinances, permits, contract limit lines as established in the<br />

Contract Documents, the rules and regulations <strong>of</strong> the <strong>College</strong>, or as ordered by the Contracting Officer or its authorized<br />

representative, and shall not unreasonably encumber the site or the premises with its materials, tools and equipment.<br />

4.6.2 The Contractor shall at all times during the Progress <strong>of</strong> the Work keep the premises and the job site<br />

free from the accumulation <strong>of</strong> all refuse, rubbish, scrap materials and debris caused by its operations, to the end that at<br />

all times the premises and site shall present a neat, orderly and workmanlike appearance. This is to be accomplished as<br />

frequently as is necessary by the removal <strong>of</strong> such material, debris, etc. from the site and the <strong>College</strong>'s premises.<br />

Loading, cartage, hauling and dumping will be at the Contractor's expenses.<br />

4.6.3 At the completion <strong>of</strong> the Work, the Contractor shall remove all its tools, construction equipment,<br />

machinery, temporary staging, falsework, formwork, shoring, bracing, protective enclosures, scaffolding, stairs, chutes,<br />

ramps, runways, hoisting equipment, elevators, derricks, cranes, etc. from the <strong>Project</strong> Site.<br />

4.6.4 Should the Contractor not promptly and properly discharge its obligation relating to Cleaning and<br />

Final Clean Up, the <strong>College</strong> shall have the right to employ others and to charge the cost there<strong>of</strong> to the Contractor after<br />

first having given the Contractor a three (3) working day written notice <strong>of</strong> such intent.<br />

4.6.5 The Contractor's responsibilities in final clean up include:<br />

a. Removal <strong>of</strong> all debris and rubbish resulting from or relating to its work.<br />

Rubbish shall not be thrown from building openings above the ground<br />

floor unless contained within chutes;<br />

b. Removal <strong>of</strong> putty stains from glass and mirrors; wash and polish inside<br />

and outside;<br />

c. Removal <strong>of</strong> marks, undesirable stains, fingerprints, other soil, dust or dirt<br />

from painted, decorated or stained woodwork, plaster or plasterboard,<br />

metal acoustic tile and equipment surfaces;<br />
