ARTICLE 4<br />

THE CONTRACTOR<br />

4.1 Review <strong>of</strong> Contract<br />

4.1.1 The Contractor has the duty and warrants and represents that he has thoroughly examined and is<br />

familiar with all the Contract Documents, including but not limited to, the complete set <strong>of</strong> Drawings and Specifications<br />

<strong>of</strong> the entire project; that he has carefully examined the site and that from its own investigations he has satisfied himself<br />

as to the nature and location <strong>of</strong> the Work, the current local equipment labor and material conditions, and all matters<br />

which may in any way affect the Work or its performance. The Contractor is responsible to check and verify reasonably<br />

observable conditions outside the Contract Limit Lines to determine whether any conflict exists with the work he is<br />

required to perform under the Contract. This includes a check on elevations, utility connections and other site data. As<br />

a result <strong>of</strong> such examination and investigation, the Contractor warrants and represents that he fully understands the intent<br />

and purposes <strong>of</strong> the Contract Documents and its obligations there under and that he accepts responsibility for and is<br />

prepared to execute and fulfill completely, by its construction work, the intent <strong>of</strong> the Contract, without exception and<br />

without reservation, at the price and within the timeframe specified in the Contract.<br />

4.1.2 The Contractor shall carefully study and compare the Contract Documents during the progress <strong>of</strong> the<br />

Work and shall immediately report any error, inconsistency or omission to the Construction Manager upon discovery<br />

and shall do no work thereafter which may be affected by such error until the <strong>College</strong> has had the opportunity to respond<br />

and clarify the work it wants performed in view <strong>of</strong> this information. Wherever any error, inconsistency or omission<br />

appears, it shall be disposed <strong>of</strong> pursuant to appropriate procedures set forth elsewhere herein.<br />

4.1.3 Unless otherwise ordered in writing by the Contracting Officer, the Contractor shall perform no<br />

portion <strong>of</strong> the Work without approved Change Orders, approved Shop Drawings or Samples for such portions <strong>of</strong> the<br />

Work, or other approvals as may be applicable and required by the Contract Documents.<br />

4.1.4 Unless otherwise provided in the Contract Documents, the Contractor shall provide and pay for all<br />

labor, equipment, material, tools, construction equipment and machinery, water, heat, utilities, transportation and other<br />

facilities and services necessary for the proper execution and completion <strong>of</strong> the Work, whether or not incorporated or to<br />

be incorporated in the Work.<br />

4.1.5 The Contractor shall at all times enforce strict discipline and good order among its employees and<br />

shall not employ any unfit person or anyone not skilled in the task assigned to him.<br />

4.1.6 The Contractor shall be obligated to pay the prevailing wage rates as required by the State <strong>of</strong> <strong>New</strong><br />

<strong>Jersey</strong>. He shall abide by the requirements <strong>of</strong> the State's Affirmative Action Program. He also shall be responsible to<br />

insure that all principles <strong>of</strong> Safety are carried out as further described in Article 12 herein.<br />

4.2 <strong>New</strong> <strong>Jersey</strong> Prevailing Wage Act<br />

4.2.1 Each Contractor or any Subcontractor shall comply with the <strong>New</strong> <strong>Jersey</strong> Prevailing Wage Act Laws<br />

<strong>of</strong> 1963, Chapter 150, and all amendments thereto as this Act is hereby made a part <strong>of</strong> every Contract entered into on<br />

behalf <strong>of</strong> the <strong>College</strong> except those contracts which are not within the contemplation <strong>of</strong> the Act. Provisions <strong>of</strong> the Act<br />

include:<br />

a. All workmen employed in the performances <strong>of</strong> every Contract in which the Contract Sum is<br />

in excess <strong>of</strong> $2,000 and Work to which the <strong>College</strong> is a party, shall be paid not less than the<br />

Prevailing Wage Rate as designed by the Commissioner <strong>of</strong> Labor and Industry or its duly<br />

authorized representative.<br />
