epresentative shall meet with the Contractor for joint review, correction, or adjustment <strong>of</strong> the proposed plan and<br />

schedule. Within ten (10) calendar days after the joint review, the Contractor will revise the Critical Path Method<br />

schedule in accordance with agreement reached during the joint review and shall submit one (1) hard copy and one (1)<br />

electronic copy to the <strong>College</strong>. The resubmission will be reviewed by the <strong>College</strong> and, if found to be as previously<br />

agreed upon, will be approved. An approved copy <strong>of</strong> each will be returned to the Contractor. The Contractor shall<br />

approve the schedule at that time provided, however, if any Contractor objects to the schedule to be adopted, he shall,<br />

within ten (10) days, state its objections in writing to the Contracting Officer, specifying its precise position <strong>of</strong> the<br />

schedule to which he objects and the reasons therefore and identifying the basis <strong>of</strong> its objection. The Contractor will be<br />

deemed to have accepted the schedule as adequate, proper and binding in all respects and shall not raise objections to<br />

the schedule except to the extent as required in this article. The Contractor will then meet with the <strong>College</strong><br />

Representative to develop a contractually compliant schedule which removes all <strong>of</strong> the Contractors objections. The<br />

Contractor will revise the Critical Path Method schedule in accordance with the agreements reached during this final<br />

review and shall submit one (1) hard copy and one (1) electronic copy to the <strong>College</strong>. The resubmission will be<br />

reviewed by the <strong>College</strong> and if found to be as previously agreed upon, will be approved. An approved copy <strong>of</strong> each will<br />

be returned to the Contractor. Approval will be without reservation and the Contractor will be deemed to have accepted<br />

the schedule as adequate, proper and binding in all respects and shall not raise objections to the schedule.<br />

9.2.6 Once every month, or more <strong>of</strong>ten if required by the <strong>College</strong>, the Contractor shall<br />

meet with <strong>College</strong>'s Representative and provide the updated Critical Path Method schedule which<br />

shall clarify all <strong>of</strong> the following:<br />

(1) Approved Changes in activity sequencing;<br />

(2) Changes in activity durations for unstarted or partially completed<br />

activities where agreed upon;<br />

(3) The effect to the network <strong>of</strong> any delays in any activities in progress and/or<br />

the impact <strong>of</strong> known delays which are expected to affect future work;<br />

(4) The effect <strong>of</strong> Contractor Modifications (activity durations, logic and cost<br />

estimates) to the network;<br />

(5) Changes to activity logic, where agreed upon, to reflect revision in the<br />

Contractor's work plan; i.e. changes in activity duration, cost estimates,<br />

and activity sequences for the purpose <strong>of</strong> regaining lost time or improving<br />

progress; and<br />

(6) Changes to milestones, due dates, and the overall Contract Completion<br />

Date which have been agreed upon by the <strong>College</strong> since the last revision<br />

<strong>of</strong> the CPM Schedule.<br />

9.2.7 The CPM schedule shall accurately reflect the manner in which the Contractor<br />

intends to proceed with the project and shall incorporate the impact <strong>of</strong> all delays and Change Orders<br />

as soon as these factors can be defined. All changes made to the schedule shall be subject to approval<br />

by the <strong>College</strong> prior to inclusion in the CPM schedule. If unapproved Contractor logic and time<br />

durations are used, the Contractor agrees that any time which is projected to be lost on the project as a<br />

result <strong>of</strong> these schedule changes will be considered the responsibility <strong>of</strong> the Contractor until a final<br />

agreement has been made or a final decision rendered by the <strong>College</strong> regarding the manner in which<br />

the Change Order work is to be reflected on the schedule. When this final decision has been made by<br />

the <strong>College</strong>, the Contractor shall revise the CPM schedule in accordance with such decision and issue<br />

a final analysis <strong>of</strong> the effect <strong>of</strong> the change on the project. If the Contractor desires to revise the logic<br />

<strong>of</strong> the approved CPM schedule so as to reflect a sequence <strong>of</strong> construction which differed from that<br />

originally agreed to, he must first obtain the approval <strong>of</strong> the <strong>College</strong>.<br />
