(1) Each Contractor and Subcontractor performing public work for the<br />

<strong>College</strong> who is subject to the provisions <strong>of</strong> the Prevailing Wage Act, shall<br />

post the Prevailing Wage Rates for each craft and classification involved<br />

as determined by the Commissioner, including the effective date <strong>of</strong> any<br />

changes there<strong>of</strong>, in prominent and easily accessible places at the site <strong>of</strong><br />

the work or at such place or places as are used by them to pay workmen<br />

their wages.<br />

(2) The Contractor's signature on the proposal is its guarantee that neither it,<br />

nor any Subcontractor, is currently listed by, or on record with, the<br />

Commissioner as one who has failed to pay the Prevailing Wages<br />

according to the Prevailing Wage Act.<br />

b. In the event it is found that any workman, employed by any Contractor or any Subcontractor<br />

covered by any Contract in excess <strong>of</strong> $2,000 for any public work to which the <strong>College</strong> is a<br />

party, has been paid a rate <strong>of</strong> wages less than the Prevailing Wage required to be paid by<br />

such Contract, the Contracting Officer <strong>of</strong> the <strong>College</strong> may terminate the Contractor's or<br />

Subcontractor's right to proceed with the work, or such part <strong>of</strong> the work as to which there has<br />

been a failure to pay required wages and may otherwise prosecute the work to completion.<br />

c. Nothing contained in the Prevailing Wage Act shall prohibit the payment <strong>of</strong> more than the<br />

prevailing wage rate to any workman employed on a public work.<br />

4.3 Supervision and Construction Procedures<br />

4.3.1 The Contractor shall supervise and direct the Work using its best skill and attention. He shall be<br />

solely responsible for all construction means, methods, techniques, sequences and procedures and for coordinating all<br />

portions <strong>of</strong> the Work under the Contract.<br />

4.3.2 The Contractor shall employ a full-time competent Superintendent and necessary Foreman and<br />

assistants, who shall be in attendance on the <strong>Project</strong> site during the progress <strong>of</strong> the Work. The Superintendent shall<br />

represent the Contractor and all communications given to the Superintendent shall be as binding as if given to the<br />

Contractor. Important communications shall be confirmed in writing. The <strong>College</strong> reserves the right to require a change<br />

in any Contractor personnel if its performance, as judged by the Contracting Officer or its authorized representative, is<br />

deemed to be inadequate. Upon application, in writing to the Contracting Officer or its authorized representative, this<br />

requirement for full-time superintendent may be waived by the Contracting Officer should he determine that such<br />

staffing is not required by the <strong>College</strong>.<br />

4.3.3 Each Contractor shall employ qualified competent craftsmen in their respective lines <strong>of</strong> work.<br />

4.3.4 The various Subcontractors shall likewise have competent Superintendents and/or Foremen in charge<br />

<strong>of</strong> their respective portions <strong>of</strong> the Work at all times. They shall not employ a person unfit or unskilled in the work<br />

assigned to him. If it should become apparent that a Subcontractor does not have its portion <strong>of</strong> the Work under control<br />

<strong>of</strong> a competent Foreman, the Contractor shall have the obligation to take appropriate steps to immediately provide<br />

proper supervision.<br />

4.3.5 If, due to a trade agreement, standby personnel are required to supervise equipment installation or for<br />

any other purpose, during normal working hours or overtime hours <strong>of</strong> other trades, the Contractor normally employing<br />

the trade required to provide such standby services, shall evaluate and include the costs there<strong>of</strong> in its bid price and shall<br />

provide said services without additional charge to the <strong>College</strong>.<br />

4.3.6 The Contractor shall make new Work fit existing work and/or existing conditions at Contractor’s<br />

cost and expense. Changes in the Work attributable to varying field and/or existing conditions which represent a<br />

minor difference from those indicated on the drawings or can be reasonably predicted or expected to be encountered<br />
