Otherwise, when a claim for weekly payments is made, the insurer is required to: • Make a decision, and commence weekly payments if liability is accepted, within 21 days of receiving the claim. Section 274 (1). However, if provisional weekly payments have already commenced, the time frame in which the claim must be determined may be extended to: • the end of the period approved for provisional payments. Section 274 (3). If the period of provisional weekly payments expires within 21 days from the lodgement of the claim: • the insurer may continue to make provisional weekly payments having regard to the nature of the injury and the period of incapacity. Claims for Medical Expenses Insurer are also required to: • Consider accepting liability for medical expenses on a provisional basis (including medical, hospital and rehabilitation expenses) for an amount of up to $5000. Section 280 (1). • Make a decision on a claim for medical expenses within 21 days of receiving the claim. Special Conditions 1. Provisional weekly payments must commence within 7 days UNLESS the insurer has a “reasonable excuse” for not commencing them. Section 267 (1). Reasonable excuses will be explored in the next session. 2. The approval of provisional weekly payments and/or medical expenses does not constitute an admission of liability by the insurer or employer. Section 267 (4), 274 (5) and 280 (2). 3. If a claim is made on a date after the initial notification, the maximum possible period of provisional weekly payments expires 12 weeks after the date of initial incapacity. Section 274 (4). Payments to Injured Workers NSW workers compensation legislation sets out what benefits are available for an injured worker. Benefits depend on whether the incapacity is total or partial, and how long someone has been away from their normal duties. Statutory benefit levels are adjusted every six months to reflect movements in the ABS Wage Cost Index (WCI) for ordinary time hourly rates of pay excluding benefits.
