For information on how to notify WorkCover see the accompanying Information Sheet: ‘Accident and Injury Notifications -What Employers and Insurance Companies Need To Do’. What are the penalties for not notifying a work-related incident? The employer must notify WorkCover of any incident listed above immediately. Except where the injury is not serious i.e. not life threatening or not a serious illness, the penalties are listed below under section 86 of the OHS Act 2000. The maximum penalty for not notifying is: – $82,500 in the case of a corporation (being a previous offender) – $55,000 in the case of a corporation (not a previous offender) – $41,250 in the case of an individual (being a previous offender) – $22,000 in the case of an individual (not a previous offender) Employers notifi cation to insurers By law employers must notify their insurance company within 48 hours of becoming aware of a Workers Compensation Injury where the employee is likely to have more than 7 days off work. Employers must notify the insurance company within 7 days of all other claims. All other claims (that is, employees off work for less than 7 days) must be notified within 7 days. The employer must provide the name of the workers compensation insurer If a claim is required then your employer must provide you with a Workers Compensation form. The employer is also required to forward the claim form onto the insurer for processing. The employer must provide the details of the insurance company to the injured employee. Employers must have a register of injuries book Under Section 63 of the Workplace Injury Management and Workers Compensation Act 1998, employers are required to keep a register of injuries that is readily accessible in the workplace. The manager of any mine or quarry or the occupier of any factory, workshop, office or shop is responsible for this register of injuries. Sample of a register of injuries book Below is an example of the information that will be useful in a workplace injuries book so that an accurate record of workplace accidents and injuries can be kept. These records can be used to measure which workstations, processes or activities constitute risks in the workplace so that appropriate action can be taken to minimise these risks, as well as providing future reference on any workplace injury.
