SECTION IIISTEPS TO BE TAKEN WHEN CDBG AND/OR HOME ASSISTEDACQUISITION, REHABILITATION, CONVERSION ORDEMOLITION CAUSES DISPLACEMENTThe Uniform Relocation Assistance and Real Property Acquisition Policies Act <strong>of</strong>1970, as amended (Uniform Act) provides important protections and assistance forpeople affected by the acquisition, rehabilitation, or demolition <strong>of</strong> real property forfederal or federally funded projects with CDBG or HOME funds. In compliance withthe Uniform Act, the <strong>City</strong> <strong>of</strong> <strong>Champaign</strong> will ensure that people whose real property isacquired, or who involuntarily move as a direct result <strong>of</strong> projects receiving thesefederal funds, are treated fairly and equitably and receive assistance in relocating andmoving from the property they occupy.On February 3, 2005, the Uniform Act regulations were amended to incorporatefurther clarifications on the applicability <strong>of</strong> the Act to federal programs. This Sectionincorporates any revisions applicable, as a result <strong>of</strong> the recently amended UniformAct regulations at 49 CFR Part 24.If, as a direct result <strong>of</strong> a federally assisted project or activity, it becomes necessary torelocate persons, they shall be eligible for relocation benefits and services as outlinedbelow (49 CFR Part 24, Subpart C-E):A. Permanent DisplacementMoving Expenses - Subject to the limitations and definitions contained in49 CFR, Subpart D, a displaced owner-occupant or tenant <strong>of</strong> a dwellingis entitled to either:a. Reimbursement <strong>of</strong> actual, reasonable moving expenses for thetransportation <strong>of</strong> themselves and personal property, includingpacking, storage (if necessary), and other eligible expenses;ORb. A fixed moving expense payment determined in according to theapplicable schedule approved by the Federal Highway Administrationbased on the number <strong>of</strong> rooms <strong>of</strong> furniture.
