Appendix BAPPEALSThe <strong>City</strong> <strong>of</strong> <strong>Champaign</strong> will promptly review appeals in accordance with therequirements <strong>of</strong> applicable law and 49 CFR Part 24.10 <strong>of</strong> the Uniform Actregulations.Any person who believes he/she has been displaced for a federally assistedproject may file a written appeal with the <strong>City</strong> <strong>of</strong> <strong>Champaign</strong> that isadministering the grant funds under CDBG and HOME. If a person believesthat the <strong>City</strong> <strong>of</strong> <strong>Champaign</strong> has failed to properly consider the person'sapplication for assistance under the Uniform Act or Section 104(d) <strong>of</strong> theHousing and Community Development Act, by denying benefits, an appealshould be sent to, and will be reviewed by, the <strong>City</strong> <strong>of</strong> <strong>Champaign</strong>. Pleasecontact the <strong>City</strong> <strong>of</strong> <strong>Champaign</strong> if you wish to discuss an appeal at:Neighborhood Services Director102 N Neil Street<strong>Champaign</strong>, IL 61820217-403-7070Assistance, or lack there<strong>of</strong>, that can be appealed may include the person'seligibility for, or the amount <strong>of</strong>, payments required for moving, replacementhousing or commercial re-establishment.The <strong>City</strong> <strong>of</strong> <strong>Champaign</strong> shall consider written appeals regardless <strong>of</strong> form. Allappeals must be received within 90 days after the person receives writtennotification <strong>of</strong> the <strong>City</strong>'s determination on the person's claim.A person has a right to be represented by legal counsel or other representativein connection with his or her appeal, but solely at the person's own expense.The <strong>City</strong> <strong>of</strong> <strong>Champaign</strong> shall permit a person to inspect and copy all materialspertinent to his or her appeal, except materials which are classified asconfidential. The imposition <strong>of</strong> reasonable conditions on the person's right toinspect, consistent with applicable laws, will be set.In deciding an appeal, the <strong>City</strong> <strong>of</strong> <strong>Champaign</strong> will consider pertinent justificationand material submitted by the person, to ensure a fair and full review <strong>of</strong> theappeal. Promptly after receipt <strong>of</strong> all information submitted by a person insupport <strong>of</strong> an appeal, the <strong>City</strong> <strong>of</strong> <strong>Champaign</strong> shall make a written determinationon the appeal, including an explanation <strong>of</strong> the basis on which the decision wasmade, and furnish the person a copy.Appendix H 221
