funding the project, or the displacing Agency; or(2) Another reason, such as a delay in the construction of thereplacement dwelling, military duty, or hospital stay, as determined bythe City of Champaign.f. Conversion of PaymentA displaced person who initially rents a replacement dwelling, and receives arental assistance payment under Sec. 24.402(b), is eligible to receive anyremaining payment in a lump sum, if the person meets the eligibility criteria forsuch payments. To convert a payment to homeownership assistance, a personmust purchase and occupancy a unit within the prescribed 1-year period. Anyportion of the rental assistance payment that has been disbursed shall bededucted from the payment computed.g. Payment After DeathA replacement housing payment is personal to the displaced person and uponhis or her death the un-disbursed portion of any such payment shall not be paidto the heirs or assigns, except that:(1) The amount attributable to the displaced person's period of actualoccupancy of the replacement housing shall be paid.(2) Any remaining payment shall be disbursed to the remaining family membersof the displaced household in any case in which a member of a displaced familydies.(3) Any portion of a replacement housing payment necessary to satisfy thelegal obligation of an estate in connection with the selection of a replacementdwelling by or on behalf of a deceased person shall be disbursed to the estate.h. Insurance ProceedsTo the extent necessary to avoid duplicate compensation, the amount of anyinsurance proceeds received by a person in connection with a loss to thedisplacement dwelling due to a catastrophic occurrence (fire, flood, etc.) shallbe included in the acquisition cost of the displacement dwelling whencomputing the price differential. (See Sec. 24.3.)i. No Duplication of PaymentsThere is a prohibition against the City of Champaign making a payment to aperson under the Uniform Act regulations that would duplicate another paymentthe person receives under Federal, State, or local law. The City of ChampaignAppendix H 215
is not required to conduct an exhaustive search for such other payments; it isonly required to avoid creating a duplication based on the City’s knowledge atthe time a payment is computed.j. Expeditious PaymentsThe City of Champaign shall review claims in an expeditious manner. Theclaimant shall be promptly notified as to any additional documentation that isrequired to support the claim. Payment for a claim shall be made as soon asfeasible following receipt of sufficient documentation to support the claim.k. Advanced PaymentsIf a person demonstrates the need for an advanced relocation payment in orderto avoid or reduce a hardship, the City of Champaign may issue the payment,subject to such safeguards as are appropriate to ensure that the objective ofthe payment is accomplished.l. Time for FilingAll claims for a relocation payment shall be filed with the City of Champaign nolater than 18 months after the date of displacement. The City of Champaignmay waive this time period for good cause.m. Notice of Denial of ClaimIf the City of Champaign disapproves all or part of a payment claimed orrefuses to consider the claim on its merits because of untimely filing or othergrounds, it shall promptly notify the claimant in writing of its determination, thebasis for its determination, and the procedures for appealing that determination.n. Expenditure of PaymentsPayments, provided pursuant to this part, shall not be considered to constituteFederal financial assistance or income for the purposes of reporting such asincome to the Internal Revenue Service.o. Unlawful Occupant (squatters)A person who occupies without property right, title or payment of rent, or aperson legally evicted, with no legal rights to occupy a property under Statelaw.
