It is anticipated that through the analysis of the reports litigationtrends in the Province will be established thus informing the courseof action that needs to be pursued to ameliorate areas that arecommon cause for litigation thereby reducing litigation costs.Legal Advice and OpinionsDuring the course of this financial year the Chief Directorateprovided legal advice and opinions on a wide spectrum of issues.The issues ranged from Local Government issues pertaining tothe validity of transfers of councillors from one municipal districtto another, and the competency to assign functions delegated toMembers of the Executive Council by National Government. Otheradvice included issues pertaining to the development of a foodbank, remuneration issues regarding special advisors, repaymentof bursaries, copyright issues and access to information issues.Service Level AgreementsAn integral part of vetting agreements is ensuring that theyadvance the Gauteng City Region objectives of the GPG, that theyare legally sound, comply with existing policies and protect theinterests of the Office of the Premier. Agreements ranging fromdeveloping a 2014 strategy and reviewing the alignment of GPGdepartments to branding Gauteng, employment contracts fortemporary staff, and a telecom and plant maintenance monitoringand evaluation framework were vetted.Training and Advocacy IssuesThe Legal Forum in the Province is becoming an effective networkfor deliberating on legal issues. It is serving as an integral platformfor discussing new legal issues and developments affecting theProvince. Attendance of forum meetings by heads of legal unitswithin departments requires attention to ensure that discussionsremain of strategic importance. Some pertinent issues discussedwere the Nyathi judgment, contract management, the ConsumerProtection Act, Regulatory Impact Assessment and the PersonalInformation Bill and its implications for access to information.Training on the Promotion of Administrative Justice Act, 2000(Act No. 3 of 2000) and the Promotion of Access to InformationAct, 2000 (Act No. 2 of 2000) are ongoing. All departments areaware of the compliance requirements. The Office has publishedan Access to information Manual and submitted its reports to theSouth African Human Rights Commission and the Departmentof Justice in terms of section 32 and section 15 of the two Actsrespectively.44
