contract or otherwise. In these cases the employment may be for the particular work rather than<br />

for a term. 98<br />

The county eng<strong>in</strong>eer is responsible for prepar<strong>in</strong>g all plans and estimates for the construction of<br />

bridges and super<strong>in</strong>tend their construction, mak<strong>in</strong>g all estimates and plans of work to be done <strong>in</strong><br />

the construction and ma<strong>in</strong>tenance of roads and super<strong>in</strong>tend the work, review<strong>in</strong>g the report to the<br />

board of supervisors on the ma<strong>in</strong>tenance work that should be done to properly upkeep and<br />

ma<strong>in</strong>ta<strong>in</strong> all roads and bridges <strong>in</strong> the county, and check<strong>in</strong>g over and report<strong>in</strong>g to the board of<br />

supervisors on all estimates before payment by the board of supervisors of all work done on<br />

public roads. 99<br />

The county eng<strong>in</strong>eer may be required to furnish plans and estimates, and may super<strong>in</strong>tend the<br />

construction of any road under the supervision of the state highway commission, if the highway<br />

commission may so elect. This provides a means for the board of supervisors and the highway<br />

commission to cooperate on such a project, when possible, and reduce the expense of<br />

construction of any road. 100<br />

The compensation of the county eng<strong>in</strong>eer shall be determ<strong>in</strong>ed by the board of supervisors. The<br />

manner of mak<strong>in</strong>g such compensation shall be spread annually upon the m<strong>in</strong>utes of the board. 101<br />

Road Manager<br />

Code, § 65-17-1 establishes the county road department, discusses the employment of a county<br />

road manager, and prescribes the duties and powers of the county road manager. All counties<br />

operat<strong>in</strong>g under the county-wide system of road adm<strong>in</strong>istration, or unit system, are required to<br />

appo<strong>in</strong>t a road manager and operate a centralized county-wide road department. Counties<br />

operat<strong>in</strong>g under the district (beat) system may adopt all or part of the road policies and<br />

procedures applicable to unit counties, but are not required to by law.<br />

In unit system counties, the board of supervisors is required to adopt general policies concern<strong>in</strong>g<br />

the adm<strong>in</strong>istration of the county road department. Those policies and procedures are<br />

adm<strong>in</strong>istered by the county road manager.<br />

The county road manager should be experienced and knowledgeable <strong>in</strong> the areas of construction<br />

and ma<strong>in</strong>tenance of roads and bridges. 102 S<strong>in</strong>ce this type of expertise is required, the board of<br />

supervisors may appo<strong>in</strong>t the county eng<strong>in</strong>eer to also serve as road manager and may also serve <strong>in</strong><br />

the same capacity <strong>in</strong> two separate counties. 103 The road manager cannot be a member of the board<br />

of supervisors. 104<br />

The road manager is required to assist the county adm<strong>in</strong>istrator <strong>in</strong> the preparation of a road<br />

budget. The road budget should <strong>in</strong>clude all anticipated expenditures for the next fiscal year for<br />

the ma<strong>in</strong>tenance and the construction of all county roads and bridges. The proposed budget<br />

should be submitted to the board of supervisors for approval. 105<br />

The road manager, subject to approval of the board of supervisors, may hire assistants and<br />

employees necessary to ma<strong>in</strong>ta<strong>in</strong> the county road system. The road manager has full supervision<br />
