absent or disabled, the board may elect another member to preside dur<strong>in</strong>g the absence of the<br />

president or vice president. 47<br />

Three (3) members of the board of supervisors constitute a quorum. If a quorum of the board is<br />

not present on the first day of any regular, adjourned, or special meet<strong>in</strong>g, the sheriff may adjourn<br />

the meet<strong>in</strong>g from day to day until a quorum is present. A member of the board of supervisors,<br />

properly notified, who fails to attend any meet<strong>in</strong>g will be f<strong>in</strong>ed $5.00 per day for each day he is<br />

absent. Unless the absent supervisor provides a “sufficient excuse” at the next meet<strong>in</strong>g, he must<br />

pay the f<strong>in</strong>e <strong>in</strong>to the county treasury. Until any such f<strong>in</strong>e is paid, <strong>in</strong>clud<strong>in</strong>g any costs associated<br />

with collection of the f<strong>in</strong>e, the supervisor cannot receive any “allowance” or warrants from the<br />

county. 48<br />

Sheriff and Clerk of the Board<br />

The sheriff (or a deputy sheriff) must attend all meet<strong>in</strong>gs of the board to execute its process and<br />

orders. 49 Provided, however, the board of supervisors may go <strong>in</strong>to executive session without the<br />

sheriff at the discretion of the board. 50 The clerk of the board, the chancery clerk (or a deputy<br />

chancery clerk or a clerk pro tempore 51 ), must attend meet<strong>in</strong>gs of the board to “keep and<br />

preserve a complete and correct record of all the proceed<strong>in</strong>gs and orders of the board.” The clerk<br />

records on the m<strong>in</strong>utes the names of those members of the board <strong>in</strong> attendance and the names of<br />

those members absent. 52<br />

Regular Monthly Meet<strong>in</strong>gs<br />

State law requires every county board of supervisors to meet as a m<strong>in</strong>imum the first Monday of<br />

every month. 53 The meet<strong>in</strong>g generally must be held <strong>in</strong> the courthouse or chancery clerk’s office,<br />

but the board may meet <strong>in</strong> any other county-owned build<strong>in</strong>g located with<strong>in</strong> one (1) mile of the<br />

courthouse, provided the board enters an order on its m<strong>in</strong>utes designat<strong>in</strong>g and describ<strong>in</strong>g <strong>in</strong> full<br />

the build<strong>in</strong>g and room to be used as the meet<strong>in</strong>g room for the board of supervisors and, more<br />

than thirty (30) days before the place for the meet<strong>in</strong>g changes, posts <strong>in</strong> the chancery clerk’s<br />

office and <strong>in</strong> one (1) other place <strong>in</strong> the courthouse a “conspicuous, permanent notice” of the<br />

meet<strong>in</strong>g location change and publishes notice <strong>in</strong> the manner prescribed by statue. 54 In counties<br />

hav<strong>in</strong>g two (2) court districts the meet<strong>in</strong>gs of the board of supervisors must alternate between the<br />

two court districts. 55<br />

Alternate Meet<strong>in</strong>g Times and Location<br />

As is the case with the organizational meet<strong>in</strong>g of the board of supervisors, if it is not practicable<br />

for the board to meet at the normal time and <strong>in</strong> the normal place, the president, or the vice<br />

president <strong>in</strong> the absence or disability of the president, or any three members, may call a meet<strong>in</strong>g<br />

<strong>in</strong> a place designated with<strong>in</strong> the county. 56 However, the board of supervisors may not hold<br />

meet<strong>in</strong>gs or transact official acts outside the county <strong>in</strong> which they were elected. 57<br />

Adjourned Meet<strong>in</strong>gs<br />

The board of supervisors may adjourn a regular meet<strong>in</strong>g to any date and time it determ<strong>in</strong>es by<br />

plac<strong>in</strong>g an order upon its m<strong>in</strong>utes. The order provid<strong>in</strong>g for the adjourned meet<strong>in</strong>g must specify<br />
