The term “purchase” means buy<strong>in</strong>g, rent<strong>in</strong>g, leas<strong>in</strong>g or otherwise acquir<strong>in</strong>g.<br />

The term “certified purchas<strong>in</strong>g office” means any purchas<strong>in</strong>g office <strong>in</strong> which fifty percent<br />

(50%) or more of the purchas<strong>in</strong>g agents hold a certification from the Universal Public<br />

Purchas<strong>in</strong>g Certification Council or other nationally recognized purchas<strong>in</strong>g certification,<br />

and <strong>in</strong> which, <strong>in</strong> the case of a state agency purchas<strong>in</strong>g office, <strong>in</strong> addition to the national<br />

certification, one hundred percent (100%) of the purchas<strong>in</strong>g officials hold a certification<br />

from the State of <strong>Mississippi</strong>'s Basic or Advanced Purchas<strong>in</strong>g Certification Program.<br />

State Contract Price for Purchase of Commodities – Code, § 31-7-12<br />

The Department of F<strong>in</strong>ance and Adm<strong>in</strong>istration Office of Purchas<strong>in</strong>g and Travel, a state agency<br />

located <strong>in</strong> Jackson, is responsible for obta<strong>in</strong><strong>in</strong>g contracts for the purchase of many commodities<br />

for state agencies. This <strong>in</strong>formation is made available to all govern<strong>in</strong>g authorities.<br />

The county purchase clerk must be familiar with commodities under state contracts. Govern<strong>in</strong>g<br />

authorities may purchase commodities from the state contract vendor, or from any source<br />

offer<strong>in</strong>g the identical commodity, at a price not exceed<strong>in</strong>g the state contract price established for<br />

such commodity, without obta<strong>in</strong><strong>in</strong>g or advertis<strong>in</strong>g for competitive bids. [If this option is not<br />

used, bid requirements must be followed.] This exception is not applicable to purchases of<br />

<strong>in</strong>formation technology products on contracts approved by Information Technology Services, a<br />

state agency.<br />

Bid Requirements – Code, § 31-7-13<br />

All counties shall purchase their commodities and pr<strong>in</strong>t<strong>in</strong>g, contract for garbage collection or<br />

disposal, contract for solid waste collection or disposal, contract for sewage collection or<br />

disposal, contract for public construction and contract for rentals as follows:<br />

Purchases which do not <strong>in</strong>volve an expenditure of more than Five Thousand Dollars<br />

($5,000.00), exclusive of freight or shipp<strong>in</strong>g charges, may be made without advertis<strong>in</strong>g or<br />

otherwise request<strong>in</strong>g competitive bids. [The county may use a competitive solicitation<br />

process if it so chooses.]<br />

Purchases which <strong>in</strong>volve an expenditure of more than Five Thousand Dollars ($5,000.00)<br />

but not more than Fifty Thousand Dollars ($50,000.00), exclud<strong>in</strong>g freight or shipp<strong>in</strong>g<br />

charges, may be made from the lowest and best bidder without publish<strong>in</strong>g or post<strong>in</strong>g<br />

advertisement for bids, provided at least two (2) competitive written bids have been obta<strong>in</strong>ed.<br />

The term “competitive written bid” shall mean a bid submitted on a bid form<br />

furnished by the buy<strong>in</strong>g agency or govern<strong>in</strong>g authority (county) and signed by authorized<br />

personnel represent<strong>in</strong>g the vendor, or a bid submitted on a vendor’s letterhead or<br />

identifiable bid form and signed by authorized personnel of the vendor. “Competitive”<br />

shall mean that the bids are developed based upon comparable identification of the needs<br />

and are developed <strong>in</strong>dependently and without knowledge of other bids or prospective<br />

bids. Bids may be submitted by facsimile, electronic mail or other generally accepted<br />
