ZONING ORDINANCES, SUBDIVISION REGULATIONS,<br />
AND BUILDING CODES<br />
Once a county has adopted a comprehensive plan for future development, it should be used as a<br />
guide <strong>in</strong> decision-mak<strong>in</strong>g by the board of supervisors. It should <strong>in</strong>fluence the thought process of<br />
practically every meet<strong>in</strong>g as the board sets policy and carries out actions to improve the county.<br />
There will be dozens of board of supervisors’ orders and local regulations which will reflect the<br />
<strong>in</strong>tent of the comprehensive plan. There are, however, three types of ord<strong>in</strong>ances which have the<br />
specific purpose of implement<strong>in</strong>g the comprehensive plan. They are the: (1) zon<strong>in</strong>g ord<strong>in</strong>ance;<br />
(2) subdivision regulations; and (3) build<strong>in</strong>g codes.<br />
Zon<strong>in</strong>g Ord<strong>in</strong>ances<br />
The zon<strong>in</strong>g ord<strong>in</strong>ance conta<strong>in</strong>s two elements – a text which sets forth the various zon<strong>in</strong>g<br />
classifications and allowable uses with<strong>in</strong> those classifications and a map which del<strong>in</strong>eates how<br />
every parcel of land <strong>in</strong> the county is zoned.<br />
The zon<strong>in</strong>g ord<strong>in</strong>ance text can be as detailed or as simple as a community wants to make it. For<br />
example, the orig<strong>in</strong>al zon<strong>in</strong>g ord<strong>in</strong>ance adopted by DeSoto County over forty (40) years ago was<br />
about fifteen (15) pages long and had four (4) zones: agricultural, residential, commercial, and<br />
<strong>in</strong>dustrial. The current ord<strong>in</strong>ance is eighty (80) pages and conta<strong>in</strong>s fifteen (15) different zon<strong>in</strong>g<br />
classifications. Both of those ord<strong>in</strong>ances follow the same format, however.<br />
The ord<strong>in</strong>ance starts out with a general statement of title and purpose. Then there is a list of<br />
def<strong>in</strong>itions which are necessary to <strong>in</strong>sure that everyone knows what the various terms and<br />
procedures mean.<br />
The actual schedule of district regulations follows. This lists the various districts which will be<br />
conta<strong>in</strong>ed <strong>in</strong> the ord<strong>in</strong>ance, it establishes what uses will be allowed by right (permitted uses) and<br />
perhaps others which could be allowed <strong>in</strong> certa<strong>in</strong> situations (conditional uses), it imposes<br />
restrictions on the location of structures with<strong>in</strong> lots (setback requirements), and establishes other<br />
limitations which the board of supervisors deem appropriate. The ord<strong>in</strong>ance will conta<strong>in</strong> sections<br />
deal<strong>in</strong>g with procedures for amendments, conditional uses, signs, nonconform<strong>in</strong>g uses<br />
(grandfather clause for uses exist<strong>in</strong>g at the time of ord<strong>in</strong>ance adoption), request for variances<br />
from the requirements of the ord<strong>in</strong>ance, off-street park<strong>in</strong>g, and ord<strong>in</strong>ance adm<strong>in</strong>istration.<br />
The adm<strong>in</strong>istration of the zon<strong>in</strong>g ord<strong>in</strong>ance requires, as a m<strong>in</strong>imum, a plann<strong>in</strong>g commission and<br />
staff to carry out the ord<strong>in</strong>ance. It must provide an appeals board or board of adjustment for<br />
persons who feel aggrieved by the provisions of the ord<strong>in</strong>ance or its application of them. The<br />
plann<strong>in</strong>g commission itself is made up of citizens appo<strong>in</strong>ted by the board of supervisors and<br />
usually ranges <strong>in</strong> size from five (5) to fifteen (15) people. Actions of the plann<strong>in</strong>g commission<br />
are usually recommendations to the board of supervisors who must approve the decisions of the<br />
plann<strong>in</strong>g commission.<br />
