that the proposed activity or exercise of power is <strong>in</strong> fact a legitimate public function relat<strong>in</strong>g to<br />

“county affairs, property and f<strong>in</strong>ances.” If it is not, then home rule cannot be used as a source of<br />

authority for such activity. If the activity is a legitimate public function of the county, there<br />

rema<strong>in</strong>s the equally difficult issue of determ<strong>in</strong><strong>in</strong>g whether or not there are statutes or laws that<br />

prohibit or otherwise control or regulate the proposed exercise of power. If the answer to this<br />

question is yes, then home rule still does not provide a source of authority to engage <strong>in</strong> the<br />

proposed activity, although the activity may be a legitimate public concern of the county.<br />

Notwithstand<strong>in</strong>g these difficulties, the county home rule statute does offer a potential source of<br />

authority that may, <strong>in</strong> proper circumstances, empower the board of supervisors with the authority<br />

and flexibility to address matters of “county affairs, property and f<strong>in</strong>ances” which have not<br />

otherwise been addressed by state law.<br />

Board Attorney<br />

POWERS REGARDING GENERAL ADMINISTRATION<br />

The board is authorized to employ counsel to assist it <strong>in</strong> the conduct of meet<strong>in</strong>gs and to<br />

otherwise provide legal counsel with respect to matters of concern and <strong>in</strong>terest to the board and<br />

county. 70<br />

County Property, Offices, Furnish<strong>in</strong>gs, and Supplies<br />

The board of supervisors is required by law to properly furnish the courthouse and supply and<br />

equip all county offices with necessary office supplies, equipment and furnish<strong>in</strong>gs. 71 To<br />

accomplish this objective, express statutory authority is delegated to the board of supervisors to<br />

purchase real estate for county build<strong>in</strong>gs, 72 and dispose of surplus real property 73 and personal<br />

property 74 belong<strong>in</strong>g to the county. The board is authorized to <strong>in</strong>sure county personal and real<br />

property aga<strong>in</strong>st casualty loss 75 and specifically employ a person to manage and care for county<br />

property. 76 An important adm<strong>in</strong>istrative requirement with respect to county property is the<br />

statutory mandate that the boards of supervisors establish and ma<strong>in</strong>ta<strong>in</strong> an accurate <strong>in</strong>ventory<br />

control system. 77<br />

Other Adm<strong>in</strong>istrative Matters<br />

Among the most important adm<strong>in</strong>istrative responsibilities of the board of supervisors is the<br />

adoption of the county budget 78 and approval of expenditures and appropriation of county funds<br />

therefore. 79 These subjects are covered at length <strong>in</strong> other chapters of this book. Other general<br />

adm<strong>in</strong>istrative duties <strong>in</strong>clude approval of the bonds of chancery clerk, circuit clerk, and other<br />

county officers and employees, 80 the establishment of vacation and sick leave policies and a<br />

system for county-wide personnel adm<strong>in</strong>istration, 81 contract<strong>in</strong>g for professional services, 82<br />

attend<strong>in</strong>g professional educational programs, 83 provid<strong>in</strong>g a plan of liability <strong>in</strong>surance for the<br />

county and county employees, 84 provid<strong>in</strong>g for workers’ compensation coverage for county<br />

employees, 85 provid<strong>in</strong>g for unemployment compensation benefits for county employees, 86<br />

establish<strong>in</strong>g <strong>in</strong>mate canteen funds, 87 employ<strong>in</strong>g a county adm<strong>in</strong>istrator, 88 provid<strong>in</strong>g for the<br />
