addition to the “public notice of meet<strong>in</strong>gs” requirements specified <strong>in</strong> the paragraphs above, the<br />

Open Meet<strong>in</strong>gs Act requires certa<strong>in</strong> actions with respect to recess, adjourned, or special<br />

meet<strong>in</strong>gs. Specifically, the Act states:<br />

Any public body which holds its meet<strong>in</strong>gs at such times and places and by such<br />

procedures as are specifically prescribed by statute shall cont<strong>in</strong>ue to do so and no<br />

additional notice of such meet<strong>in</strong>g shall be required except that a notice of the<br />

place, date, hour and subject matter of any recess meet<strong>in</strong>g, adjourned meet<strong>in</strong>g,<br />

<strong>in</strong>terim meet<strong>in</strong>g or any special called meet<strong>in</strong>g shall be posted with<strong>in</strong> one (1) hour<br />

after such meet<strong>in</strong>g is called <strong>in</strong> a prom<strong>in</strong>ent place available to exam<strong>in</strong>ation and<br />

<strong>in</strong>spection by the general public <strong>in</strong> the build<strong>in</strong>g <strong>in</strong> which the public body normally<br />

meets. A copy of the notice shall be made a part of the m<strong>in</strong>utes or other<br />

permanent official records of the public body. 62<br />

Subpoena Powers<br />

The board has the power to subpoena witnesses <strong>in</strong> all matters com<strong>in</strong>g under its jurisdiction and to<br />

f<strong>in</strong>e and imprison any person for a contempt committed while the board is <strong>in</strong> session. The f<strong>in</strong>e<br />

for contempt may not exceed fifty dollars ($50.00) and the imprisonment may not extend beyond<br />

the cont<strong>in</strong>uance of the term. A person so f<strong>in</strong>ed or imprisoned may appeal to the circuit court. 63<br />

M<strong>in</strong>utes of the Board<br />

M<strong>in</strong>utes must be ma<strong>in</strong>ta<strong>in</strong>ed of each and every meet<strong>in</strong>g and same must be signed and<br />

published. 64 The requirement to properly ma<strong>in</strong>ta<strong>in</strong> m<strong>in</strong>utes cannot be over emphasized. The<br />

board of supervisors speaks and acts only through its m<strong>in</strong>utes. 65 The m<strong>in</strong>utes of each day’s<br />

proceed<strong>in</strong>gs must either be read and signed by the president (or vice president if the president is<br />

absent or disabled so as to prevent his sign<strong>in</strong>g the m<strong>in</strong>utes) on or before the first Monday of the<br />

month follow<strong>in</strong>g the day of adjournment of any “term” of the board of supervisors or be adopted<br />

and approved by the board as the first order of bus<strong>in</strong>ess on the first day of the next monthly<br />

meet<strong>in</strong>g of the board. 66<br />

<strong>Mississippi</strong>’s Open Meet<strong>in</strong>gs Act provides with respect to m<strong>in</strong>utes of meet<strong>in</strong>gs of public bodies<br />

the follow<strong>in</strong>g:<br />

M<strong>in</strong>utes shall be kept of all meet<strong>in</strong>gs of a public body, whether <strong>in</strong> open or<br />

executive session, show<strong>in</strong>g the members present and absent; the date, time, and<br />

place of the meet<strong>in</strong>g; an accurate record<strong>in</strong>g of any f<strong>in</strong>al actions taken at such<br />

meet<strong>in</strong>g; and a record, by <strong>in</strong>dividual member, of any votes taken; and any other<br />

<strong>in</strong>formation that the public body requests be <strong>in</strong>cluded or reflected <strong>in</strong> the m<strong>in</strong>utes.<br />

The m<strong>in</strong>utes shall be recorded with<strong>in</strong> a reasonable time not to exceed thirty (30)<br />

days after recess or adjournment and shall be open to public <strong>in</strong>spection dur<strong>in</strong>g<br />

regular bus<strong>in</strong>ess hours . . . 67 19
