records, 90 and fund<strong>in</strong>g abstract of land titles <strong>in</strong> the chancery clerk’s office. 91<br />
Elections<br />
With respect to elections, the board of supervisors has the responsibilities of determ<strong>in</strong><strong>in</strong>g the<br />
supervisor district l<strong>in</strong>es, 92 provid<strong>in</strong>g for election districts and vot<strong>in</strong>g prec<strong>in</strong>cts, 93 provid<strong>in</strong>g vot<strong>in</strong>g<br />
mach<strong>in</strong>es, 94 mak<strong>in</strong>g appo<strong>in</strong>tments to fill vacancies <strong>in</strong> county offices, and call<strong>in</strong>g special elections<br />
<strong>in</strong> connection therewith. 95 The electoral process is covered <strong>in</strong> more detail <strong>in</strong> Chapter 15 of this<br />
book.<br />
POWERS REGARDING LAW ENFORCEMENT AND COURTS<br />
The members of the board of supervisors are conservators of the peace with<strong>in</strong> their respective<br />
counties, and possess the powers as such which are conferred on justice court judges. 96 However,<br />
the primary powers and duties of supervisors with respect to law enforcement and courts focus<br />
on fund<strong>in</strong>g the offices, employees, facilities and programs of the sheriff and the court system.<br />
Sheriff’s Office<br />
Under state law, the sheriff is required, at the July meet<strong>in</strong>g of the board of supervisors, to submit<br />
a budget of estimated expenses of his office for the ensu<strong>in</strong>g fiscal year beg<strong>in</strong>n<strong>in</strong>g October 1 <strong>in</strong> a<br />
form prescribed by the Department of Audit. It is the responsibility of the board of supervisors to<br />
exam<strong>in</strong>e the sheriff’s proposed budget and determ<strong>in</strong>e the amount to be expended by the sheriff <strong>in</strong><br />
the performance of his duties for the fiscal year; the board may <strong>in</strong>crease or reduce said amount as<br />
it deems necessary and proper. 97 The budget shall <strong>in</strong>clude amounts for compensat<strong>in</strong>g the deputies<br />
and other employees of the sheriff’s office; for <strong>in</strong>surance provid<strong>in</strong>g protection for the sheriff and<br />
his deputies <strong>in</strong> case of disability, death and other similar coverage; for travel and transportation<br />
expenses of the sheriff and deputies; for feed<strong>in</strong>g prisoners and <strong>in</strong>mates of the county jail; for<br />
equipment and supplies; and for such other expenses as may be <strong>in</strong>curred <strong>in</strong> the performance of<br />
the duties of the office of sheriff.<br />
In addition to f<strong>in</strong>al budget approval, the board of supervisors is required to properly provide,<br />
furnish, and supply an office for the sheriff. 98 The board has the discretionary authority to<br />
authorize the purchase of motor vehicles and equipment needed for operation of the sheriff’s<br />
office. 99 In <strong>in</strong>stances where identify<strong>in</strong>g marks and decals will h<strong>in</strong>der official <strong>in</strong>vestigations, the<br />
board may approve the sheriff’s use of unmarked vehicles subject to statutory limitations. 100 The<br />
board may also purchase and ma<strong>in</strong>ta<strong>in</strong> law enforcement dogs for the sheriff’s use 101 and establish<br />
radio stations for law enforcement. 102<br />
County Patrol Officers<br />
The board of supervisors has discretionary authority to employ and equip county patrol officers<br />
whose duty it shall be to patrol the roads of the county and to enforce the road and motor vehicle<br />
laws. 103 23
