e given three (3) months from the date on which the board was given notice to come <strong>in</strong>to<br />

compliance with the requirements of Section 9-1-46. The Adm<strong>in</strong>istrative Office of Courts shall<br />

notify the board of supervisors of any justice court clerk who fails to come <strong>in</strong>to compliance after<br />

the three-month notice required <strong>in</strong> this subsection. Any noncompliant clerks shall be term<strong>in</strong>ated<br />

for failure to comply with Section 9-1-46 report<strong>in</strong>g requirement. 42<br />

Every justice court judge is required to take the oath of office prescribed by Article 6, § 155 of<br />

the <strong>Mississippi</strong> Constitution. Justice court judges are also required to post a bond <strong>in</strong> the same<br />

manner as other county officers. Justice court judges are required to give bond payable <strong>in</strong> a<br />

penalty not less than fifty thousand dollars ($50,000). 43<br />

If the justice court judge resigns from office or the term of office expires he is required to deliver<br />

with<strong>in</strong> ten (10) days of vacat<strong>in</strong>g the office, the case record with all papers and books of statutes<br />

relat<strong>in</strong>g to the office of justice court judge, to the clerk of the justice court. 44<br />

Sheriff<br />

The office of sheriff, established <strong>in</strong> Article 5, § 135 of the <strong>Mississippi</strong> Constitution, is filled<br />

through an at-large election. A sheriff serves a four (4) year term or until his successor shall be<br />

qualified. 45 A sheriff is eligible to immediately succeed himself <strong>in</strong> office. 46<br />

Before tak<strong>in</strong>g office, if the sheriff-elect has not previously served as sheriff or had at least five<br />

(5) years of experience as a full-time enforcement officer with<strong>in</strong> the previous ten (10) years, or<br />

has not previously completed an applicable tra<strong>in</strong><strong>in</strong>g course at the <strong>Mississippi</strong> Law Enforcement<br />

Officers’ Academy or the Jackson Police Academy with<strong>in</strong> the previous five (5) years, he is<br />

required to attend and complete an appropriate curriculum at the <strong>Mississippi</strong> Law Enforcement<br />

Officers’ Academy. 47<br />

The sheriff’s duties are wide-spread and far-reach<strong>in</strong>g, but they generally fall <strong>in</strong>to two broad<br />

categories: law enforcement and adm<strong>in</strong>istrative. The law enforcement duties are the duties<br />

typically associated with the sheriff’s office. These duties are specifically “to keep the peace<br />

with<strong>in</strong> <strong>in</strong> the county, by caus<strong>in</strong>g all offenders <strong>in</strong> his view to enter <strong>in</strong>to bonds, with sureties, for<br />

keep<strong>in</strong>g the peace and for appear<strong>in</strong>g at the next circuit court, and by committ<strong>in</strong>g such offenders<br />

<strong>in</strong> case of refusal.” 48 The sheriff is also charged with the duty to “quell riots, routs, affrays and<br />

unlawful assemblages, and to prevent lynch<strong>in</strong>gs and mob violence.” 49<br />

The adm<strong>in</strong>istrative duties for the sheriff are numerous. One of the most recognizable<br />

adm<strong>in</strong>istrative duties of the sheriff is to serve as the county’s jailor, except <strong>in</strong> any county <strong>in</strong><br />

which there is a jo<strong>in</strong>tly owned jail. 50 (In that case, the municipality will appo<strong>in</strong>t a jailer who shall<br />

be responsible for all municipal prisoners <strong>in</strong> the jail <strong>in</strong> the same manner <strong>in</strong> which the sheriff is<br />

responsible for state prisoners, and have the same right of access to the jail as the sheriff. Code, §<br />

47-1-49.) The sheriff is required to keep separate rooms for the sexes, not permitt<strong>in</strong>g<br />

communication between male and female prisoners, unless they are married. 51 He shall also<br />

provide fire and lights when necessary and proper; sufficient and clean bedd<strong>in</strong>g; and daily<br />

wholesome and adequate food and dr<strong>in</strong>k. 52<br />
