2.2.3 Bylaws and Decision Making Structure<br />
The MOA (Appendix C2) dictates that the “Pend Oreille Watershed Planning Unit and Government<br />
participants will conduct decision-making by consensus as described in the Watershed Planning Unit<br />
By-Laws”. A copy <strong>of</strong> the bylaws for the <strong>WRIA</strong> <strong>62</strong> Planning Unit (dated January 18, 2001 and<br />
amended on September 18, 2003) are included as Appendix C3.<br />
As stated in the bylaws under Section 5b, Decision Making (as amended on September 18, 2003),<br />
<strong>WRIA</strong> <strong>62</strong> <strong>WMP</strong> <strong>032305</strong><br />
“The Planning Unit shall operate by consensus for the decision making process.<br />
Consensus is defined as an agreement by all consensus building members. <strong>State</strong><br />
and Federal agency representatives will vote with one voice respectively. Any<br />
issue requiring consensus, will be voted on by attending members, the attending<br />
members will decide if the issue is administrative or non-administrative.<br />
Administrative decisions require one vote to adopt. Non-administrative decisions<br />
take either two Planning Unit votes or one Planning Unit vote followed by a<br />
physical mailing to Planning Unit members explaining the proposed issue.<br />
Planning Unit members will have one week (from time <strong>of</strong> mailing) to respond.<br />
Failure to respond results in a sustained vote.”<br />
The Watershed Planning Unit reaffirmed at the January 15, 2004 Planning Unit meeting<br />
decision making by consensus <strong>of</strong> all Planning Unit members. At the January 15, 2004<br />
Planning Unit meeting, different forms <strong>of</strong> consensus were agreed to as follows:<br />
Strong consensus - I like it !<br />
Endorse with minor reservations - Basically, it’s OK.<br />
Liveable solution - I can live with it.<br />
Abstain - I have no opinion.<br />
Stand aside - It would not be my choice, but it’s not so important to me that I want to<br />
stand in the way <strong>of</strong> the group.<br />
Formal minority report - I’ll support the decision, but I want my disagreement to be<br />
noted in writing.<br />
2.2.4 Technical Committees<br />
Although not formally recognized in the MOA nor the bylaws, the Planning Unit establishes technical<br />
committees as needed to work through specific issues and to bring these issues to the Planning Unit.
