1.37.8 Violations of <strong>the</strong> provisions of <strong>the</strong> Living Wage Program will<br />

subject <strong>the</strong> Contractor to withholding of monies owed <strong>the</strong><br />

Contractor under <strong>the</strong> contract, liquidated damages, possible<br />

termination and/or debarment from future County contracts in<br />

accordance with Los Angeles County Code, Chapter 2.202,<br />

Determinations of Contractor Non-Responsibility and Contractor<br />

Debarment, Appendix K.<br />

1.37.9 Contractors that submit false in<strong>for</strong>mation may be barred from<br />

participating in <strong>the</strong> prospective contract and future County<br />

contracts in accordance with Los Angeles County Code, Chapter<br />

2.202, Determinations of Contractor Non-Responsibility and<br />

Contractor Debarment, Appendix K .<br />

1.38 PROPOSER’S CHARITABLE CONTRIBUTIONS COMPLIANCE<br />

1.38.1 Cali<strong>for</strong>nia’s “Supervision of Trustees and Fundraisers <strong>for</strong><br />

Charitable Purposes Act” regulates receiving and raising<br />

charitable contributions. Among o<strong>the</strong>r requirements, those subject<br />

to <strong>the</strong> Charitable Purposes Act must register. The 2004 Nonprofit<br />

Integrity Act (SB 1262, Chapter 919) increased Charitable<br />

Purposes Act requirements. Prospective Contractors should<br />

carefully read <strong>the</strong> Background and Resources: Cali<strong>for</strong>nia<br />

Charities Regulations, Appendix N. New rules cover Cali<strong>for</strong>nia<br />

public benefit corporations, unincorporated associations, and<br />

trustee entities and may include similar <strong>for</strong>eign corporations doing<br />

business or holding property in Cali<strong>for</strong>nia. Key Nonprofit Integrity<br />

Act requirements affect executive compensation, fund-raising<br />

practices, and documentation. Charities with over $2 million of<br />

revenues (excluding funds that must be accounted <strong>for</strong> to a<br />

governmental entity) have new audit requirements.<br />

1.38.2 All prospective Contractors must determine if <strong>the</strong>y receive or raise<br />

charitable contributions which subject <strong>the</strong>m to <strong>the</strong> Charitable<br />

Purposes Act and complete <strong>the</strong> Charitable Contributions<br />

Certification, as set <strong>for</strong>th in Appendix C, Exhibit B-19 -. A<br />

completed Exhibit B-19 is a required part of any Contract with <strong>the</strong><br />

County.<br />

1.38.3 In Exhibit 19, prospective Contractors certify ei<strong>the</strong>r that:<br />

• <strong>the</strong>y have determined that <strong>the</strong>y do not now receive or raise<br />

charitable contributions regulated under <strong>the</strong> Cali<strong>for</strong>nia<br />

Charitable Purposes Act, (including <strong>the</strong> Nonprofit Integrity<br />

Act) but will comply if <strong>the</strong>y become subject to coverage of<br />

those laws during <strong>the</strong> term of a County contract,<br />
