SUMMARY OF COMMENTS AND RESPONSESIn addition, text in DEIR Section IV.E.2.0, page IV-4 has been revised:Implementation of these mitigation measures, in addition to the mitigation measurelisted in Section IV.D.2.0, above, would reduce the significant impacts to naturalresources from proposed mining operations to a less than significant level.Comment H-11: “<strong>SFPUC</strong> apparently did not correspondingly review for discharge water qualityviolations. However, the <strong>Alameda</strong> Creek Alliance viewed the records on file at the RegionalWater Quality Control Board and noted many self-reported violations of water quality permits forRMC Pacific Materials, including exceedances of allowed turbidity levels, and non-reportingviolations. Mission Valley Rock Company had not filed self-monitoring reports for the past fiveyears.How can the <strong>SFPUC</strong> be considering expansion of quarrying leases, let alone continuation ofexisting leases to leaseholders which violate the terms of their permits and the terms of theirleases (which require compliance with all permits)?” (<strong>Alameda</strong> Creek Alliance)Response: It is unclear from the above comment which RMC Pacific Materials permits thecommentor is referring to. RMC Pacific Materials’ water discharge regulatory requirements arecovered by NPDES (National Pollutant Discharge Elimination System) permit NumberCA0005363, adopted by RWCQB Order Number 94-095, on August 17 th , 1994. There have beenno notices of violations of this permit and no exceedances of permit conditions during the periodJanuary 1, 1994 to March 15, 2000.Two NPDES permits cover Mission Valley Rock’s water discharge regulatory requirements.Operations in Sunol are covered by a storm water discharge permit under the Industrial ActivitiesStorm Water General Permit (WQ Order 97-03-DWQ) adopted 4/17/97, WDID #2015012002.Mission Valley Rock Co. files an annual report and is inspected annually under this permit. Thesecond Mission Valley Rock NPDES permit was adopted by RWQCB Order #97-037 in Marchof 1997. The NPDES permit Number is CA 0030066. Mission Valley Rock began dischargingunder this permit March 18, 1998. This permit requires sampling to be conducted weekly at eachactive discharge point for substances established by the above-mentioned order. Monthly andannual reports are filed under this permit.
