Chapter 16<str<strong>on</strong>g>Nuclear</str<strong>on</strong>g> Fuel CycleAnatoly DyakovIt is now quite clearly understood that the greatest risk to the nuclearn<strong>on</strong>proliferati<strong>on</strong> regime is the proliferati<strong>on</strong> of the methods usedto produce fissile nuclear materials. As the example of North Koreahas dem<strong>on</strong>strated c<strong>on</strong>vincingly, a country that has access to the technologiesof uranium enrichment and/or spent nuclear fuel reprocessingcould potentially develop a nuclear weap<strong>on</strong> quickly, even whilebeing a party to the <str<strong>on</strong>g>Nuclear</str<strong>on</strong>g> N<strong>on</strong>-Proliferati<strong>on</strong> Treaty (NPT) andhaving its facilities under IAEA safeguard. Speaking figuratively, formerIAEA director general M. ElBaradei has called the nuclear fuelcycle the “Achilles’ heel” of the n<strong>on</strong>proliferati<strong>on</strong> regime. 1The very presence of a breach in the n<strong>on</strong>proliferati<strong>on</strong> regime as seriousas the development of the NFC [nuclear fuel cycle], which somec<strong>on</strong>sider to be a loophole in the n<strong>on</strong>proliferati<strong>on</strong> regime, naturallyprompts questi<strong>on</strong>s about both the extent to which the NPT is meetingthe goals of n<strong>on</strong>proliferati<strong>on</strong> and its ability to adequately protectinternati<strong>on</strong>al security from new threats that may arise. Under currentc<strong>on</strong>diti<strong>on</strong>s, when the main threat is seen as being related to nuclearterrorism or to efforts by certain countries to acquire nuclear weap<strong>on</strong>s,a top-to-bottom review and fundamental adaptati<strong>on</strong> of NPTmechanisms and regimes will be required, as well as a detailizati<strong>on</strong>of the implicati<strong>on</strong>s behind some of its requirements (particularlythose c<strong>on</strong>cerning the scope of IAEA safeguards, the framework forpeaceful nuclear cooperati<strong>on</strong> under Articles III and IV, the proceduresfor withdrawing from the Treaty under Article X, the exportc<strong>on</strong>trol regime, and other measures). In this c<strong>on</strong>text, the nuclear fuelcycle will remain <strong>on</strong>e of the more challenging issues.C<strong>on</strong>cerns about the sharp rise in oil and natural gas prices andshortages of fossil fuel reserves have led many countries in the world,including developing countries, to turn to nuclear power in orderto satisfy their energy needs.
