338<str<strong>on</strong>g>Nuclear</str<strong>on</strong>g> <str<strong>on</strong>g>Reset</str<strong>on</strong>g>: Arms Reducti<strong>on</strong> and N<strong>on</strong>proliferati<strong>on</strong>It would be especially important to agree in advance <strong>on</strong> acti<strong>on</strong>sto be taken against a regime that violates the NPT while still a memberand then expects to be able to withdraw from the Treaty obligati<strong>on</strong>swith impunity. Since the country would remain resp<strong>on</strong>sible forany NPT violati<strong>on</strong>s it committed prior to withdrawal, it would seemappropriate to spell out in advance the c<strong>on</strong>sequences of such violati<strong>on</strong>s.Indeed, the implicati<strong>on</strong>s of UNSCR 1887 are that additi<strong>on</strong>aldetailed arrangements should follow.The Internati<strong>on</strong>al Commissi<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>Nuclear</str<strong>on</strong>g> N<strong>on</strong>proliferati<strong>on</strong> andDisarmament has recommended that the UNSC should severelydiscourage withdrawal from the NPT by making it clear that suchan act would be regarded by the UNSC as a prima facie threatto internati<strong>on</strong>al peace and security and would lead to the punitivec<strong>on</strong>sequences foreseen under Chapter VII of the UN Charter. 39 Suchadvance warning about the inevitable c<strong>on</strong>sequences that would followacts of proliferati<strong>on</strong> could become an important political deterrentto attempts to use nuclear materials for military purposesA specific step in this directi<strong>on</strong> could be the adopti<strong>on</strong> of a frameworkUNSC resoluti<strong>on</strong> (based <strong>on</strong> and moving forward the relevantprovisi<strong>on</strong>s of Resoluti<strong>on</strong> 1887) c<strong>on</strong>taining specific punitive opti<strong>on</strong>sagainst a proliferator who systematically defies NPT requirementsand the relevant UNSC resoluti<strong>on</strong>s.It would also be important to enhance the capabilities of the IAEAto investigate activities that might lead to the development of nuclearweap<strong>on</strong>s. The Internati<strong>on</strong>al Commissi<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>Nuclear</str<strong>on</strong>g> N<strong>on</strong>proliferati<strong>on</strong>and Disarmament has advanced practical recommendati<strong>on</strong>s in thisfield proposing to update the Additi<strong>on</strong>al Protocol to SafeguardsAgreements by adding to the APSA specific references to dualuseitems, reporting <strong>on</strong> export denials, shorter notice period, andthe right to interview specific individuals. 40A critical challenge should be addressed, that of elaboratingagreed-up<strong>on</strong> rules of engagement in situati<strong>on</strong>s of imminent threatfrom substate actors (groups of extremists, fanatics, or terroristswho have seized or are about to seize nuclear explosive devices).In the c<strong>on</strong>text of promoting UN n<strong>on</strong>proliferati<strong>on</strong> enforcement arrangements,it would seem pertinent to return to the Russian proposalto revitalize the UNSC Military Staff Committee (MSC) to enhancethe UN’s ability to address new challenges to human security. RussianForeign Minister Sergey Lavrov drew the attenti<strong>on</strong> of the UN communityto this issue during the 61st Sessi<strong>on</strong> of the UN General Assembly.
