PRIVATE RECORDS. 181So again, one of the latest entries is as follows :—David Weddertram's(d) MemorandumMS.on the 24 Junij 1615. —(4 lines carefully obliterated in the original). It is to berememberit I have subscryuit him (? whom) ane Dispositione of the Nonetre of v acria land formit beWilliam Gray, Scheref Deput, quhairiu I grant I have receauit syluer. Item quhair he promesit to gif me ane honestsatisfactione in the agreing him and Mr. James Wedderburn in getting him a relief of his cautionrieanent Kynuard, etc.Not long, however, before this date David had lost possession of these books. Itseems that the provost sent two of the bailies to borrow them and that David thereuponlent them upon a guarantee that if the books were not returned to him within fourteen•days, the provost should pay him a thousand merkis. Whether he ever got either thebooks or the merks does not appear. He makes the following note of the matter :—(e)Memorandum to persew Thomas Halyburtoun, provest of Dundie, for the wrangis intromissione withmy fatheris protocolis extending to sex gryt bukis intromettit with (be ?) him of myn in the counselhouson the 17 of March 1629 aud promisit to restor me thame withiu 14 dayis thairefter or content me ofa thousand merkis quhilk I askit fra Johne Kamsay and William Kyneres, baileis, sent be him to mein the Kyrkzaird thairfor. The six books are now in the Dundee charter room though they do not appear to havebeen there in 1639, when Sir Alexander Wedderburn made an inventory of all books thenin his possession as clerk (post p. 206).19. Other memoranda record all sorts of matters. I have already dealt with David'sgrievances against his brother the clerk. He seems to have carried them beyond thegrave. Thus there is an undated 1 memorandum made after Kingennie's death in 1626,as follows :—(a) Memorandum to persew the clerk Mr. Alexander Wedderburn my brother sone as air and successourto Mr. Alexander Wedderburn his father and air and successour to Alexander Wedderburn, commoueClerk of Dundie, his gudschir my father for the soumes and caussis specefeit in my clame.Another note, also undated, gives one of the grounds of this claim.(6) Memorandum to crave the clerkschip of the gild eonforme to my provisione and Mr. Alexander Wedderburnfor intromissione with the beuefittis thairof my domage extending to 2000 merkis thairby.20. The following references, scattered through the volume, all name a JohnWedderburn, but cannot all refer to the same individual. 3(a) 2 Septembris 1589.—In presens of Alexander Duncan and John Wedderburn in Kyrkstyell delyueri*Robert Wedderburn my brother ane obligatione of William Kiulochs barbour of 2 C merkis and actitin the buikis of Elgyn ane Lettre of Inhibitione to the quhilk Thomas Guthre maid him assignaj (to)This in Kobertis awiu hous and I am exonerit thairof.(ft) 20 Merche 93.—In presens of Thomas Stewart Hary Balfour and John Auchinlek, James Reykylitster is oblist to litt alsmekle clayth to be my tua dochteris ilk ane of thame a cot of any hew I willrequyre for the quhilk 1 deiynerit to him his obligatione of 4 lib 40 d maid be him to my erne JohnWedderburn, wryter, and rest the sam.(c) Ane obligatione maid be George Vat to me of x merkis to be payit at Lambes 1597. Subscryvit behim and Andro Mathews and Johne Wedderburn witnessis.{d) 21 July 1618,—Send to St. Andros with John Wedderburn and Mr. Dauid Kid the Edik andExecutionis to Mr. William Weyms.1At the head of the page on which this memorandum occurs is written " Upoun the v of July 1620 "but this relates to another entry only. It cannot be the date of this one, which must have beenmade 1627— 33, the period during which David's nephew Alexander, here named as clerk, occupiedthat office. As the latest date written in the " Compt Bulk " is 12 Dec. 1630, this entry wasprobably made 1627—30.2John Wedderburn in Kirkstyell is, no doubt, the father of the Bishop of Dunblane. He died about1606, and was the great great grandson of James Wedderburn and Janet Barry, who lived "at theWest Kirk style." The second of the above entries cannot refer to him, as he was a marinerand not a "wryter." It refers, therefore, to John Wedderburn of Craigie, son of JamesWedderburn and Margaret Dundas, who appears to have bred to the law. He died about 1600.The word "erne," as applied to him cannot, however, be taken in its usual sense of "uncle."David'ji father had no brother called John, and David always calls his uncles, Robert and Peter, his " fatheris brotheris " and not his "ernes." The word, therefore, here signifies relative orcousin. The third entry tc) may refer to eithsr of these persons, while the next three (d, e,f)cannot do so, as at the date of them both were dead. They probably refer to the son of RobertWedderburn and Elizabeth Coustoun, the absence of the prefix " Mr." making it clear that theydo not refer to John Wedderburn, afterwards Sir John of Gosford, the eminent physician, whohas been mentioned ante 2(6).
