(20,)117. 1671. ipril 20.—<strong>The</strong> provost, bailies, council and deacons <strong>of</strong> crafts considering <strong>the</strong>earnest desire <strong>of</strong> Sir Alexander Wedderbum, <strong>the</strong>ir common clerk, on account <strong>of</strong> hisfrequent sicknesses, that .lames Wedderbum, his second son, who had formerly <strong>the</strong>gift <strong>of</strong> <strong>the</strong> clerkship, might be admitted conjunct clerk, and to succeed his fa<strong>the</strong>r<strong>the</strong>rein after his decease, unanimously consent <strong>the</strong>reto. <strong>The</strong> act <strong>of</strong> JamesWedderbum's admission has twenty-six signatures, but <strong>the</strong>se do not include anyone<strong>of</strong> his name. (22.)118. 1675. May 18.—<strong>The</strong> magistrates report that <strong>the</strong>y found <strong>the</strong> tenants <strong>of</strong> Blacknesspasturing on <strong>the</strong> " Magdalen Zaird," and lawfully expelled <strong>the</strong>m. (70.)A dispute as to <strong>the</strong> respective rights <strong>of</strong> <strong>the</strong> town and <strong>the</strong> Wedderbum lairds <strong>of</strong> Blackness in <strong>the</strong>Magdalen Yard continued for some time. In 1678 (Feb. 7) it was reported to <strong>the</strong> Council by <strong>the</strong>ir<strong>of</strong>ficials that <strong>the</strong> soil belonged to <strong>the</strong> town, subject to Blackness' right <strong>of</strong> way over it and pasturage<strong>the</strong>reon. Three years later, 1681 (Dec. 27), however, Blackness " extracted a decreet " in Edinburghdeclaring that <strong>the</strong> soil was his, subject to <strong>the</strong> right <strong>of</strong> <strong>the</strong> town to walk and rendezvous <strong>the</strong>reon,and on this <strong>the</strong> town seems to have taken out a summons <strong>of</strong> reduction. Eventually, 1683 (June 12),<strong>the</strong> differences were referred to Sir John Cunningham, with what result does not appear. (Thismatter is referred to at fol. 81, 82, 84, 90, 92, 95-99, 105, 152, 154, 171, 408.)119. 1676. March 7.—<strong>The</strong> council approve <strong>of</strong> James Pilmor as clerk depute to <strong>the</strong>burgh, presented to <strong>the</strong>m by Sir Alexander Wedderbum arid James Wedderbum,principal clerks, " ad vitam aut culpam," or during <strong>the</strong> council's pleasure. (80.)120. 1676. March 22 — Complaint to <strong>the</strong> council by Walter Ogilvy that a horse he hadpasturing in <strong>the</strong> Magdalen Zaird was driven <strong>of</strong>f by John Wedderbum <strong>of</strong> Blackness,upon which <strong>the</strong> council, considering that Blackness has no right to <strong>the</strong> yard, order itto be proclaimed by <strong>the</strong> drum through <strong>the</strong> town that no one is to pasture animals<strong>the</strong>re, but that it is to remain as a recreation ground for <strong>the</strong> inhabitants and <strong>the</strong>irchildren. (81.)121. 1676. Dec. 28.—Alexander Wedderbum <strong>of</strong> Easter Powrie, is unanimously electedprovost. (91.)122. 1677- (a) March 1.—Andrew Wedderbum is admitted conjunct writer with JohnWatsone, and takes his oath <strong>of</strong> fidelitie. (92.) (Ij) James Wedderbum, clerk <strong>of</strong> <strong>the</strong>burgh, signs an act <strong>of</strong> council, (ib.)123. 1677. May 15.—lames Wedderbum, common clerk, complains v. Thomas Anderson,,merchant, for having at a court held last Monday used opprobrious speeches against<strong>the</strong> clerk and his predecessors, saying that <strong>the</strong>y had made false instruments withoutground or warrant, so taking away <strong>the</strong>ir good name, which rase, 1 ase, andopprobrious speech Anderson, being charged, admits, whereupon he is amerciat inan unlaw <strong>of</strong> 100 merks scots, and decerned to remain in <strong>the</strong> tolbooth till payment,and <strong>the</strong>n ei<strong>the</strong>r to compear in a court <strong>of</strong> <strong>the</strong> magistrates and sit down upon his kneesand acknowledge his transgression, and crave pardon for <strong>the</strong> same, and promise neverto do <strong>the</strong> like hereafter, or else to stay in prison. (96.)124. 1677- Sept. 27.—Alexander Wedderbarn <strong>of</strong> Easter Powrie, is leeted and electedprovost. (100.)
