Brack tullos, An chinscurry,with mill <strong>the</strong>re<strong>of</strong>, lying within <strong>the</strong> parish <strong>of</strong> Idvie, now <strong>ca</strong>lled Kirkdean,barony <strong>of</strong> Rescobie and shire <strong>of</strong> Forfar, all <strong>of</strong> which, with <strong>the</strong> lands <strong>of</strong> Kinneres(now incorporated into one fiee tenaudiy <strong>ca</strong>lled <strong>the</strong> Tenandry <strong>of</strong> Auchinscurry)pertained to <strong>the</strong> late Sir James Wood <strong>of</strong> Bonnington and to <strong>the</strong> late David,Earl <strong>of</strong> Nor<strong>the</strong>sk, and were acquired at a public sale by <strong>the</strong> creditors <strong>of</strong> <strong>the</strong>said Earl for <strong>the</strong> use and benefit <strong>of</strong> <strong>the</strong> said now deceased John <strong>Wedderburn</strong>,doctor <strong>of</strong> medicine in Dundee, bro<strong>the</strong>r gernian <strong>of</strong> <strong>the</strong> late Sir Alexander <strong>Wedderburn</strong><strong>of</strong> Blackness, and were afterwards disponed by Sir James Wood and <strong>the</strong> o<strong>the</strong>rcommissioners for <strong>the</strong> said Earl in favour <strong>of</strong> <strong>the</strong> said Doctor John <strong>Wedderburn</strong> bydisposition dated 20 April, 17 July, and 9 Aug. 1733 and recorded in <strong>the</strong> Books<strong>of</strong> Session on 2 June 1766, and which lands, &c. <strong>the</strong> said Dr. John <strong>Wedderburn</strong>, bydisposition dated 22 March 1749 and registered in <strong>the</strong> said <strong>book</strong>s on 25 Jul}' 1751,disjjoned in favour <strong>of</strong> Margaret Balfour now deceased, <strong>the</strong>n his spouse and afterwardshis relict, in life-rent, and to <strong>the</strong> said John <strong>Wedderburn</strong>, his grandnephewand his heirs male in fee, whom failing to <strong>the</strong> o<strong>the</strong>r substitutes <strong>the</strong>reinand above mentioned, and which lands, conform to procuratory in <strong>the</strong> foresaiddisposition by <strong>the</strong> said Sir James Wood and Commissioners, were resigned into <strong>the</strong>hands <strong>of</strong> <strong>the</strong> Lords <strong>of</strong> His Majesty's Exchequer, in favour <strong>of</strong> and for new infeftment<strong>of</strong> <strong>the</strong> same to <strong>the</strong> said 1 >octor John <strong>Wedderburn</strong> and <strong>the</strong> heirs male <strong>of</strong> hisbody, whom failing to <strong>the</strong> o<strong>the</strong>r substitutes above mentioned, in <strong>the</strong> order <strong>of</strong>succession above expressed, as au<strong>the</strong>ntic instruments taken under <strong>the</strong> hands <strong>of</strong> JamesSmyth, under <strong>the</strong> order <strong>of</strong> a W.S. and notary, more fully proport. (cix, 9, fol. 12.)By this Charter are confirmed <strong>the</strong> said disposition by Sir James Wood, and an instrument <strong>of</strong>sasine following <strong>the</strong>reon, dated £0th August, and recorded at Dundee 30th September 1736, made by<strong>the</strong> said Sir James Wood and <strong>the</strong> Commissioners foresaid to <strong>the</strong> said Doctor John <strong>Wedderburn</strong> ; also<strong>the</strong> disposition by <strong>the</strong> said Doctor in favour <strong>of</strong> <strong>the</strong> said John <strong>Wedderburn</strong>, dated 22 March 1749,and sasine <strong>the</strong>reon dated 29th, and recorded at Dundee 31st, Aug. 1763. <strong>The</strong>re are confirmedalso by this Charter, in favour <strong>of</strong> <strong>the</strong> said John <strong>Wedderburn</strong>, as heir in general served andretoured to <strong>the</strong> said deceased Dr. John <strong>Wedderburn</strong>, <strong>of</strong> Idvies, his grand uncle, <strong>the</strong> writs aftermentioned,namely :— (1.) Contract <strong>of</strong> Wadset, <strong>of</strong> date 28 July it>(39, between <strong>the</strong> late Sir JohnWood <strong>of</strong> Bonnington, Knight. Baronet, on <strong>the</strong> one part, and <strong>the</strong> late Thomas Fairwea<strong>the</strong>r in Kirkton <strong>of</strong>Saint Yigean's, afterwards <strong>of</strong> Brayinston. ami Thomas Fairwea<strong>the</strong>r, his eldest lawful son, on <strong>the</strong> o<strong>the</strong>rpart, by which, for <strong>the</strong> sum <strong>of</strong> 11,01)1 merks, <strong>the</strong> former disponed to <strong>the</strong> latter, under reversion, <strong>the</strong>town and lands <strong>of</strong> Achscuriy and Bractillo, in <strong>the</strong> regality <strong>of</strong> S. Andrew's and shire <strong>of</strong> Forfar : whichcontract is recorded in <strong>the</strong> Books <strong>of</strong> Council and Session 3 Feb. 1688. (2.) Charter by <strong>the</strong> said SirJohn, in implement <strong>of</strong> <strong>the</strong> said contract dated 28 July lb'69, with confirmation <strong>of</strong> <strong>the</strong> said contract byAlexander, <strong>the</strong>n Archbishop <strong>of</strong> S. Andrew's, <strong>of</strong> date 22 May 1682. (3. ) Disposition <strong>of</strong> <strong>the</strong> said lands by<strong>the</strong> said Thomas Fairwea<strong>the</strong>r, younger, <strong>the</strong>n designed <strong>of</strong> Brayinston, in favour <strong>of</strong> George Dempster,merchant in Dundee, <strong>of</strong> date 14 April 1732. and recorded in <strong>the</strong> Books <strong>of</strong> Council and Session on2 June last. (4 ) Disposition and assign, <strong>of</strong> <strong>the</strong> said contract <strong>of</strong> wadset by <strong>the</strong> said George Dempster,in favour <strong>of</strong> Sir Alexander <strong>Wedderburn</strong> <strong>of</strong> Blackness, <strong>of</strong> date 23 Sept. 1 732, and recorded in <strong>the</strong>Books <strong>of</strong> Council and Session on 2 June last. (5.) Disposition and assign, <strong>of</strong> <strong>the</strong> said contract <strong>of</strong>wadset <strong>of</strong> <strong>the</strong> said lands and o<strong>the</strong>rs, and transmission <strong>of</strong> <strong>the</strong> same, by <strong>the</strong> said Sir Alexander<strong>Wedderburn</strong>. in favour <strong>of</strong> <strong>the</strong> said Doctor John <strong>Wedderburn</strong>, his bro<strong>the</strong>r german, <strong>of</strong> date 27 March1735. also recorded in <strong>the</strong> Books <strong>of</strong> Council and Session on 2 June last, (6.) Oblig. <strong>of</strong> corrobatiou,disposition, and assignation by <strong>the</strong> said Thomas Fairwea<strong>the</strong>r <strong>of</strong> Brayinston, in favour <strong>of</strong> JamesFairwea<strong>the</strong>r, merchant iu Dundee, his bro<strong>the</strong>r, by which he disponed to him <strong>the</strong> lauds <strong>of</strong>Achscurry and Bractillo, and <strong>the</strong> sum for which <strong>the</strong>y were wadset to <strong>the</strong> extent <strong>of</strong> 3,500 merks,contained in an obligation <strong>the</strong>rein narrated, by <strong>the</strong> said Thomas Fairwea<strong>the</strong>r to him, <strong>of</strong> date 15 June1709, with instrument <strong>of</strong> sasine following <strong>the</strong>reon dated 15 October 1709 and duly recorded ; withdisposition <strong>the</strong>re<strong>of</strong> by <strong>the</strong> said James Fairwea<strong>the</strong>r to <strong>the</strong> said Dr. John <strong>Wedderburn</strong>, <strong>of</strong> date 1 Feb.1733, and recorded in <strong>the</strong> Books <strong>of</strong> Council and Session on 2 June last: with service <strong>of</strong> <strong>the</strong> saidJohn <strong>Wedderburn</strong> now <strong>of</strong> Idvies. as heir in general <strong>of</strong> <strong>the</strong> said Doctor John <strong>Wedderburn</strong>, his granduncle,before <strong>the</strong> bailies <strong>of</strong> Dundee, dated 1 May 1758, duly retoured to Chancery. (7.) Bond <strong>of</strong>real warrandice by <strong>the</strong> said Sir James Wood <strong>of</strong> Bonnington, Brigadier-General, to <strong>the</strong> said DoctorJohn Weddderbuiui. <strong>of</strong> date 2 April 1735, and recorded in <strong>the</strong> Books <strong>of</strong> Council and Session on2 June last, whereby he obliged himself to infeft <strong>the</strong> said Doctor John <strong>Wedderburn</strong>, his heirs andassignees, heritably and irredeemably in <strong>the</strong> lands <strong>of</strong> Lethain and Newbigging in <strong>the</strong> parish <strong>of</strong>S. Vigenn's and shire <strong>of</strong> Forfar, in warrandice <strong>of</strong> <strong>the</strong> said lands <strong>of</strong> Idvies and o<strong>the</strong>rsdisponed as above, against an adjudi<strong>ca</strong>tion <strong>of</strong> date 28 July 1692, approved 26 Sept. 1682, ledat <strong>the</strong> instance <strong>of</strong> James Kiddell, merchant in Edinburgh, against <strong>the</strong> late Sir John Wood <strong>of</strong>Bonnington. his fa<strong>the</strong>r, adjudging <strong>the</strong> lands <strong>of</strong> Idvies, among o<strong>the</strong>rs, for <strong>the</strong> accumulated sum <strong>of</strong>£2,500, and in warrandice <strong>of</strong> inhibition executed against <strong>the</strong> said Sir James Wood himself at <strong>the</strong>instance <strong>of</strong> James Grieve, chirurgeon in Dundee, in 1724 or 1725, recorded iu <strong>the</strong> General Kegister,proceeding upon an obligation by him to Marion Wood, his sister, for <strong>the</strong> sum <strong>of</strong> 3,000 merks, <strong>of</strong>date 6 July 1702, and transmitted by her and Alexander Forrester, chirurgeon in Duudee, herspouse, to <strong>the</strong> said James Grieve, with procuratory <strong>of</strong> resignation and precept <strong>of</strong> sasine <strong>the</strong>reincontained, and instrument <strong>of</strong> sasine following <strong>the</strong>reon, in favour <strong>of</strong> <strong>the</strong> said Doctor John Wedder-
