July 5.—Disposition and tailzie (Birkhill, 25 May 1803) by Alexander Wed- Registerderburn <strong>of</strong> <strong>Wedderburn</strong>, advo<strong>ca</strong>te, <strong>of</strong> <strong>the</strong> lands <strong>of</strong> Easter Powrie, with teinds, &c., also<strong>of</strong> Deeds,<strong>the</strong> lands <strong>of</strong> Birkhill, &c. for new infeftment <strong>the</strong>re<strong>of</strong> to himself and <strong>the</strong> heirs <strong>of</strong> hisbody, •whom failing to <strong>the</strong> o<strong>the</strong>r heirs after mentioned, heritably and irredeemably, viz. :Henry, son <strong>of</strong> <strong>the</strong> late David Scrymgeour <strong>of</strong> Birkhill, Esq., advo<strong>ca</strong>te, (fa<strong>the</strong>r <strong>of</strong><strong>the</strong> disponer), and <strong>the</strong> heirs <strong>of</strong> his body ;Janet Scrymgeour or Gillespie, his sistergerman, relict <strong>of</strong> John Gillespie <strong>of</strong> Mountwhany, and <strong>the</strong> heirs <strong>of</strong> her body;<strong>the</strong> heirs <strong>of</strong> <strong>the</strong> body <strong>of</strong> <strong>the</strong> late Marion Scrymgeour, eldest daughter <strong>of</strong> <strong>the</strong>late Mr. Alexander Scrymgeour, Pr<strong>of</strong>essor <strong>of</strong> Divinity in S. Andrew's ;those <strong>of</strong> <strong>the</strong>late Jean Scrymgeour, second daughter <strong>of</strong> <strong>the</strong> said pr<strong>of</strong>essor; Sir John <strong>Wedderburn</strong><strong>of</strong> Ballendean, Bart, (eldest son <strong>of</strong> Sir John <strong>Wedderburn</strong> <strong>of</strong> Blackness) ; James <strong>Wedderburn</strong>,bro<strong>the</strong>r to Sir John ; Margaret <strong>Wedderburn</strong>, eldest sister to Sir John, andwife <strong>of</strong> Richard Dundas <strong>of</strong> Blair ;Charles <strong>Wedderburn</strong> <strong>of</strong> Pearsie ; John <strong>Wedderburn</strong>,son <strong>of</strong> <strong>the</strong> late Thomas <strong>Wedderburn</strong> (who was bro<strong>the</strong>r <strong>of</strong> <strong>the</strong> said Sir John <strong>Wedderburn</strong><strong>of</strong> Blackness), and <strong>the</strong> heirs <strong>of</strong> <strong>the</strong>ir bodies in order, whom all failing <strong>the</strong> disponer'sown nearest heirs and assignees whatsoever, <strong>the</strong> eldest heir female and <strong>the</strong> descendants<strong>of</strong> her body, through <strong>the</strong> whole course and order <strong>of</strong> succession above set down,excluding all o<strong>the</strong>r heirs portioners and succeeding always alone without division,
